HomeMy WebLinkAbout12926r ORDINANCE NO. 12,926 AN ORDINANCE AMENDING ORDINANCE NO. 12,905 TO CORRECT AN ERRONEOUS DESCRIPTION CONTAINED THEREIN; DIRECTING THE CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEED- INGS; AND FOR OTHER PURPOSES BE IT ORDAINED BY THE .BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The City of Little Rock does hereby condemn for parks, parkway, and roadway purposes the following parcels of real property lying in the City of Little Rock, County of Pulaski, State of Arkansas, to -wit: A tract of land lying in the NE4 NW4 and the NWa NE4 of Section 22, T -2 -N, R -13 -W, Pulaski County, Arkansas, more particularly described as follows: oa All of the West 360 feet of the NA NE4 Section 22, M T -2 -N, R -13 -W, Pulaski County, Arkansas, lying South of the Centerline of the Little Maumelle River and North of the Public Roadway dedication adjacent to o the North line of the Rock Island Railroad and all of the NE4 NW4, Section 22, T -2 -N, R -13 -W, Pulaski I>41 Q County, Arkansas, South of the Centerline of Little ro Maumelle River except the 100 foot right of way of the Q) Chicago Rook Island Railroad and the 60 foot I -430 a frontage road right of way and the 80 foot wide public o road right of way adjacent to the North line of the Rock Island Railroad. AND A tract of land situated in the County of Pulaski, State of Arkansas, being a part of Lots 1, 2, 3, 4, 5, 6, 7, and 8 of Fractional Section 15, known as Black- wood Island and accretions thereto, Township 2 north, Range 13 West of the Fifth Principal Meridian, and being more particularly described as follows: Beginning at a point on the centerline of Little Maumelle River and the common property line between the Pulaski County Penal Farm land and said Mike N. Sullivan, et al, said point being South 460 00' West approximately 1,920.00 feet from the Northeast corner of said Lot 6; thence following and binding on the meanders of said property line as follows: North 110.00 feet; North 500 36' West 724.70 feet; North 380 24' West 523.20 feet; North 340 13' West 604.60 feet; North 270 18 West 348.90 feet; North 260 46' East 2,576.00 feet; North 110 15' West:922.70 feet to a point on the ordinary high -water line designated prior to the filing on an easement deed recorded in Book 932, Page 69 to the U. S. This tract contains 4 88.67 acres, more or less. SECTION 2. The City attorney is hereby authorized and directed to file the proper court proceedings for the condemna- tion of the property described in section 1 hereof, and to secure an order of such court permitting the City to take im- mediate possession of said property upon posting a bond in an amount to be determined by the Court and to do any and all things necessary in order to obtain immediate possession of said property. SECTION 3. The acquisition and development of the lands described in this Ordinance for parks, parkway and roadway purposes along the Arkansas River is critical to the public peace, health, and safety of all citizens of the City of Littler -Rock, therefore, an emergency is declared to exist and it being necessary to pro- tect the public peace, health and safety, this ordinance shall be effective immediately upon its passage.
