AN ORDINANCE CLOSING AND VACATING AN UNPLATTED
AND UNDEDICATED STRIP OF LAND RUNNING SOUTH FROM
WEST MARKHAM STREET SOMETIMES REFERRED TO AS
"NEBLING ROAD" IN LITTLE ROCK, ARKANSAS
WHEREAS, Ione Colquette and J. Weingarten, Inc.
filed a petition with the Board of Directors of the City
of Little Rock, Arkansas, asking the Board to close, va-
cate and abandon the following described strip of land or
portion of a street (sometimes referred to as "Nebling
Road "), to wit:

A strip of land approximately 30 feet in
width, East and West, running South from
West Markham Street, the centerline of which
is described as beginning at the Northeast
corner of Lot 1, WEST MARKHAM STREET SUB-
DIVISION, to the City of Little Rock, Pulaski
County, Arkansas; thence South along said
East line 605.65 feet to the end point of
this centerline description.
WHEREAS, after due notice as required by law,
the Board of Directors has, at the time and place mention-
ed in the notice, heard all persons desiring to be heard
on the question and has ascertained that the petitioners
are the owners of all property abutting the portion of
said strip of land, or street to be closed; that the peti-
tioners, by their petition, have consented to the vacation
of the street; that the portion of the strip of land or
street to be closed is unplatted and undedicated; is not
required for public purposes; affords access, or ingress
and egress, to no property except that of said petitioners;
and has not been actually used by the public for a period
of time exceeding five (5) years; and that the public in-
terest and welfare will be benefited by abandonment of such
portion of such strip of land or street;
NOW THEREFORE,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The City of Little Rock, Arkansas,
hereby releases, vacates and abandons all its right, to-
gether with the right of the public generally, in and to
the following described strip of land or portion of a
street, to wit:
A strip of land approximately 30 feet in
width, East and West, running South from
West Markham Street, the centerline of which
is described as beginning at the Northeast
corner of Lot 1, WEST MARKHAM STREET SUB-
DIVISION, to the City of Little Rock, Pulaski
County, Arkansas; thence South along said
East line 605.65 feet to the end point of
this centerline description; subject, however,
to any public utility easement located in said
strip of land or portion of a street.
Section 2. A copy of this ordinance, duly cer-
tified by the City Clerk, shall be filed in the office of
the Recorder and recorded in the Deed Records of Pulaski
County, Arkansas.
Section 3. Whereas, the possible existence of
the aforesaid strip of land as a street is adverse to the
public interest and welfare, an emergency is declared to
exist and this ordinance shall take effect and be in force
from and after its passage.
