AN ORDINANCE CLOSING AND VACATING A PORTION
OF THE DEDICATED RIGHT OF WAY OF WEST EIGHTH
STREET BEING ADJACENT TO THE NORTH SIDE OF
BLOCK 2, PERRY HEIGHTS ADDITION TO THE CITY
OF LITTLE ROCK, ARKANSAS
WHEREAS, certain property was dedicated as street right
of way in the plat of Perry Heights Addition to the City of
Little Rock, Arkansas; and
WHEREAS, this same property, along with other property,
was conveyed to the Arkansas State Highway Department for
right of way for Interstate 630; and
WHEREAS, upon completion of this portion of Interstate
630, certain portions of the dedicated right of way are not
now needed and have been determined by the Arkansas State
Highway Department to be excess right of way; and
WHEREAS, the original grantors of the right of way have
requested that the Arkansas State Highway Department return
said excess right of way to said grantors; and
WHEREAS, in an effort to accomplish this, the State
Highway Department has executed a quitclaim deed to the City
of Little Rock, Arkansas to accomplish said return to the original
grantors; and
WHEREAS, the City of Little Rock has the authority to
vacate said right of way pursuant to Section 19 -2304, Arkansas
Statutes Annotated (1947); and
WHEREAS, the public interest will best be served by
vacating said right of way; and
WHEREAS, after due notice as required by law, the Board
of Directors has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and
has ascertained that it is in the public interest to vacate
said excess right of way; that the portion of the street
to be closed is not required for public purposes and has not
been actually used by the public for a much greater
period than five (5) years, if in fact it was ever

so used; that in fact the public interest and welfare will be
benefited by the abandonment of such portion of such street
which is more particularly described as follows, to -wit:
Part of the 8th Street Dedicated right of way, being
adjacent to the North side of Block 2, Perry Heights
Addition to the City of Little Rock, Pulaski County,
Arkansas.
Beginning at the point of intersection of the westerly
right of way line of the Tyler Street Dedication and the
existing southerly right of way line of Interstate 630;
thence North 870 30' 34" West along said existing right
of way line a distance of 233.25 feet to a point on
intersection with the proposed southerly right of way line
of said Interstate 630; thence North 84 33' 26" East
along said proposed right of way line a distance of 235.5
feet to a point; thence South 020 29' 26" West along said
proposed right of way line a distance of 32.5 feet to
the point of beginning and containing 0.09 acre, more
or less.
NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its right, together with
the right of the public generally, in and to the following
described portion of a street, to -wit:
Part of the 8th Street Dedicated right of way, being
adjacent to the North side of Block 2, Perry Heights
Addition to the City of Little Rock, Pulaski County,
Arkansas.
Beginning at the point of intersection of the westerly
right of way line of the Tyler Street Dedication and the
existing southerly right of way line of Interstate 630;
thence North 870 30' 34" West along said existing right
of way line a distance of 233.25 feet to a point on
intersection with the proposed southerly right of way line
of said Interstate 630; thence North 84 33' 26" East along
said proposed right of way line a distance of 235.5
feet to a point; thence South 020 29' 26" West along
said proposed right of way line a distance of 32.5 feet
to the point of beginning and containing 0.09 Acre, more
or less.
SECTION 2. A copy of this ordinance, duly certified
by the City Clerk, shall be filed in the office of the
Recorder and recorded in the Deed Records of Pulaski County,
Arkansas.

SECTION 3. Whereas, the existence of the aforesaid
portion of West Eighth Street and Interstate 630 shown on the
Plat of Perry Heights Addition to the City of Little Rock,
Arkansas, is adverse to the public interest and welfare, an
emergency is declared to exist and this ordinance shall take
effect and be in force from and after its passage.
