ORDINANCE NO 13,052
AN ORDINANCE APPROVING, ACCEPTING AND CONFIRMING THE
PLAT CHANGE FILED IN PULASKI COUNTY, ARKANSAS RECORD
BOOK 81 AT PAGE 208, DATED JULY 19, 1904 OF THE LOCA-
TION OF CUMBERLAND STREET BETWEEN FRACTIONAL BLOCKS
4 AND 5 OF LOT 18, RAPLEY ESTATE PLATTED AND FILED OF
RECORD ON DECEMBER 14, 1886 IN PULASKI COUNTY, ARKANSAS
RECORD BOOK 15 AT PAGE 575; DECLARING AN EMERGENCY;
AND FOR OTHER PURPOSES
WHEREAS, James R. Van Frank, the then owner of Fractional
Blocks 4 and 5, Lot 18, Rapley Estate as recorded in Pulaski
County, Arkansas, Record Book 15 at page 575 on December 14,
1886 did on July 19, 1904 file of record in Pulaski County,
Arkansas Record Book 81 at page 208 a change in the location
of Cumberland Street between the said Fractional Blocks 4 and
5 and thus accordingly changed the dimensions of said Blocks
4 and 5 by moving and locating the right -of -way of said street
twenty -one (21') feet to the East to correspond with the section
lines and adjoining property lines; and
WHEREAS, the change of the location of rights -of -way for
that portion of Cumberland Street above recited was and is in
the public interest for a public purpose and should be approved,
accepted and confirmed as the legal and proper replat of said
Fractional Blocks 4 and 5 and the right -of -way for Cumberland
Street situated between said Blocks.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. That certain plat change made and filed of
record on July 19, 1904 in Pulaski County, Arkansas Record Book
81 at page 208 changing the location of the right -of -way for
that portion of a public street identified as Cumberland Street
situated between Fractional Blocks 4 and 5, Lot 18 Rapley
Estate as platted and filed of record in Pulaski County, Arkansas
Record Book 15, at page 575 on December 14, 1886, by moving and
locating said street right -of -way twenty -one (21') feet east and
accordingly changing the dimensions of said Blocks 4 and 5 , is
hereby approved, accepted and confirmed as the legal and proper
replat of said Blocks 4 and 5 and the right -of -way for a public

street known as Cumberland Street situated between Street
Blocks.
Further, the City of Little Rock does hereby vacate,
abandon and disclaim any and all rights of the public in and
to the said street right -of -way as originally platted in 1886
that is not situated within the limits of said street right -of-
way as changed by the repl-a of 1904.
SECTION 2. It is hereby found and declared that some
question and thus confusion exists as to the location of the
right -of -way for Cumberland Street between Fractional Blocks
4 and 5, Lot 18, Rapley Estate, Pulaski County, Arkansas;
that this Ordinance will clarify the issue; that an emergency
is found to exist and this - Ordinance will be in full force and
effect from and after its passage.
