HomeMy WebLinkAbout13051ORDINANCE NO. 13,051 AN ORDINANCE AMENDING VARIOUS PROVISIONS OF CHAPTER 12 OF THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, SAID CHAPTER DEALING WITH THE ELECTRICAL CODE OF THE CITY OF LITTLE ROCK, ARKANSAS. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The following sections and subsections of Chapter 12 of the Code of Ordinances are amended as follows: A. - Section 12 -1 (a) is hereby amended to read as follows: All electrical work for light, heat, power, or any other purpose placed in or on any building or structure in the city limits shall be installed in conformity with the rules and regulations as laid down in the National Electrical Code as approved by the National Fire Protection Association and in conformity with the additional rules and regulations as set forth in this chapter. Where local rules and regulations are set forth in this chapter they shall take preference over any rules conflicting therewith. - Section 12 -1 (d) is hereby amended to read as follows: All electrical conductors operating at a difference of potential of thirty volts or more and installed in or on any building or structure in the City shall be installed by one of the following approved methods i.e., rigid metal conduit, intermediate metal conduit, flexible conduit, metal molding, steel tube, approved metal duct, approved nonmetallic conduit, flexible steel armored cable, nonmetalic sheathed cable, knob and tube work, or other wiring methods as may be specifically approved } by the Chief Electrical Inspector. Conductors of less than 30 volts will be governed by applicable sections of the National Electrical Code. - Section 12 -2 is hereby amended to read as follows: All electrical work of any kind and all systems shall satisfactorily fulfill the purpose for which it is installed and all work shall be executed in a neat and workmanlike manner. Slipshod or work not in keeping with good electrical practice shall be classified as defective and shall be immediately corrected by persons causing the same. o M (b) 1. A� bo o All conductors carrying current with potential difference in all apartments exceeding two stories in height (basement not used as residence excluded), laundry facilities for apartment complexes (except those in apartment buildings not exceeding two stories and designed only for the occupants of the building in which they exist), theaters, churches, auditoriums, garages, gasoline filling stations, hotels, office buildings, schools, and other buildings normally used for public purposes wherever located, shall be installed in approved rigid metal conduit, intermediate metal conduit, steel tube, or flex- ible conduit, commonly known as Greenfield, approved metal ducts and metal moldings. Approved rigid nonmetallic conduit may be used where nott in conflict with building codes. 2. When a business is operated in a residence or a residence is joined to a place of business wheresoever located, all wiring installed shall be in a metal raceway. Flexible steel armored cable, commonly known as BX cable, will not be permitted. (c) All wiring in non - residential buildings except as modified by Section 12 -2 (e) shall be done with wire having a minimum ampacity of 20 amperes, allowing six outlets or receptacles to the circuit provided the load is not greater than 70% of the circuit conductor rating. Lighting loads shall not exceed 70% of the circuit rating or 14 amps on a 20 amp circuit. DOD-�� -2- ampacity (dd) Residences and apartments shall be done with wire having a minimum aE20 amperes, allowing eight outlets per circuit. However, kitchens, laundry rooms, and breakfast rooms shall not have more than two duplex receptacles per 20 ampere circuit. In the absence of breakfast rooms, the same shall apply to dinettes. (e) Storerooms, stock rooms, toilets and hall -ways in non - residential buildings may have eight outlets per circuit on wire having a minimum ampacity of 20 amperes, provided this number of outlets does not overload the circuit. (f) 1. All convenience outlets for ironing boards must be installed outside the ironing board cabinet unless the ironing board unit is listed by the Under- writer's Laboratories, Inc., for the purpose for which it is used. 2. All attics on old jobs must be left open and adequate provision made for inspections. 3. On new residential construction,'junction boxes will not be permitted in attics except where necessary to be used for recessed fixtures, attic fans, and /or central heating units. (g) 1. No circuit shall be installed to operate at more than 80% of the conductor capacity. 2. Circuit breakers installed on multi -wire circuits that are designed to operate all poles simultaneously shall be factory designed as one assembly. 3. All electric ranges, in residences other than split type units, shall be supplied with conductors with minimum ampacity of SO amps and shall ter- minate in approved receptacles. These ranges shall be equipped with an approved pigtail of the proper ampacity for the range to be installed. Split type units consisting of an oven and counter top shall have a sep- arate circuit to each according to the load and may be directly connected to the circuit conductors. A range with factory equipped armored pigtail shall be connected to an approved junction box. 4. The circuit supplying electric ranges or dryers shall have an insulated neutral. A separate grounding conductor shall be provided in each circuit. S. Radiant ceiling and wall heaters shall be on a separate circuit; size wire governed by amperage load. 6. Motors of gas fired central heating systems and attic fans shall be con - nected on circuits separate from other outlets; however, they can both be connected on the same circuit as each must have a separate manually oper- ate switch and would not be operated at the same time. (h) 1. Grounding electrode conductors shall not be smaller than No. 8 gauge. Ground- ing electrode conductors in residences shall be installed in conduit or steel tube from the main line switch down the surface of the wall and through the foundation; from this point the grounding electrode conductor must be securely supported on approved insulators until it is connected to the nearest point of ground. Grounding electrode conductors in buildings where the wiring is required to be installed in metal shall be installed in rigid conduit or steel tube from the main line switch to the point of ground. 2. The grounding electrode conductor shall not be run in a raceway with other conductors. (i) 1. All wiring installed in or under concrete, asphalt paving, or other type floor on earth, shall be done with approved rigid steel conduit, IMC, or rigid non - metallic conduit not smaller than three - quarter inch and wire approved for this purpose. 2. Aluminum conduit shall not be installed in concrete or in contact with earth. EMT shall not be used in contact with earth. Conduit installations for under- ground or slabs shall be inspected before covered, or concrete is poured. (j) All bell transformers must be fused with three ampere fuses and located in acces sible places. They shall not be located in attics or other areas subject to above normal heat. (k) All multiple meter installations or service switch banks consisting of more than six shall be protected by a main. service disconnect consisting of fuses or a breaker. The main switch or breaker shall be of an approved type. No service i -3- or grouped services shall have more than six (6) breakers or means of discon- nect without a main. No building shall have more than. six mains. The one to six disconnects shall be in one enclosure except where special permission is granted for the expansion of large existing commercial. or industrial elec- trical systems or for non - residential multiple occupancy buildings. Service entrance switches shall be marked with name, address, and telephone number of the electrical contractor installing such work. Apartment houses or other multiple meter installations shall also have plainly marked the number of the apartment or sufficient load designation;1marking shall be permanent. 2. Service entrance switches and meter loops shall be located in readily acces- sible places on the exterior of the structure or other approved outside locations. The height of the meter sockets shall not be less than six feet to the bottom of the socket. Special permission may be granted for stacked meters. Special permission may be granted to permit the service equipment for commercial or industrial buildings to be located immediately inside the building as conditions require. 3. Services from the meter to the point of service entrance shall be installed in rigid metal, intermediate metal conduit, or rigid nonmetallic conduit. The feeders from the main disconnect to the branch circuit panels shall be installed in rigid metal conduit, intermediate metal conduit, electrical metallic tubing, flexible metal conduit, rigid nonmetallic conduit, or ap- proved nonmetallic cable. On Multi -unit structures, nonmetallic cable shall not cross apartments or units other than the one in which it terminates. (o) In existing structures, where new wiring is being installed, a;iy existing haz- ardous wiring must be corrected, open knife sw:i.tciies, open fuse blocks, etc., removed before the new wiring will be approved. (p) No job shall be considered as being completely roughed -in until all joints have been soldered and taped, or approved connections and pigtails provided for the hanging of fixtures. (q) Nonmetallic cable may be run over the top of ceiling joist in attics when the maximum distance from the top of the joist to the bottom of the rafter is not greater than three (3) feet, in attic space of greater height, boring of the joists or protective stripping of a minimum of I" x 3" strips will be required. D. - Section 12 -3 (b) is hereby amended to read as follows: (b) Penalty for failure to obtain permit. In case it shall be discovered that any electrical work has been installed or put into use, for which no permit has been issued, the violator shall pay a fee equal to three times the permit fee which shall have been paid for work done in violation thereof and no additional per- mits shall be granted until all fees have been paid. E. , Section 12 -3 (c) is hereby amended to read as follows: IL45 (c) Application for permit. All permits required for electrical work of any nature must be secured by the master electricain in charge prior to the commencement of such work. EXCEPTION: A building contractor shall, be permitted to secure electrical permits and to request inspections on temporary power centers for use dur- ing construction of one and two - family dwellings. The permit may be taken and scheduled for inspection the following workday or it may be placed on a special "Will Call" file to be held until being requested. The actual construction and maintenance of the temporary construction meter shall be done by a licensed electrical contractor. When a reinspection fee is required as a result of an improper installation, it shall be secured by the electrical contractor making the correction. F. - Section 12 -3 (e) is hereby amended to read as follows: (e) Fees. All applications for permits shall be accompanied by the inspection fees as hereinafter provided for. A minimum fee of $3.00 will be required for each permit. G. Section 12 -3 -(f) is hereby amended to read as follows: (f) How to be made. I. When a project consists of more than one structure, eaqh separate structure shall have a separate electrical permit. For purposes'of determining where separate permits are needed, buildings not having a common attic space, con- nected only by a canopy, walkway, or similar connection shall be deemed to be separate buildings. 2. For outdoor sales and display lots the above rule shall apply. 5 • -6- 5. For special equipment or apparatus for which no inspection fees are fixed by this article, a charge of .75� per 1,000 watts or less consumed by such equipment or apparatus shall be made. 6. When a temporary electrical construction meter is desired during the course of construction or alteration of a building, temporary permit will be issued at the regular permit fee. 7. Before any power is supplied to the permanent distribution system of a building under construction, written notice must be submitted to this office noting the length of time the temporary power will be needed before the final electrical inspection is made, the understanding that the structure will not be occupied until after the final inspection, and that the party submitting the request will assume liability of any damage incurred as a result of discon- nection of power from the building as a result of a violation of this ordi- nance. The time limit on temporary power being furnished to a building will be determined on the basis of need, not to exceed 30 days. An extension of time may be granted only by special permission. 8. In case the electrical inspector is required to make more than one trip for the purpose of inspecting any work on account of violation of'rule; wrong address, or any other irregularities caused by the master electrician or his agents, a charge of five dollars ($5.00) shall be made for each addi- tional trip. H. Section 12 -3 (1) is hereby amended to read as follows: (i) Final Inspection. 1. Before any electrical current shall be used upon any electrical wiring of any character, the electrical contractor or his master electrican shall notify the Chief Electrical Inspector or his assistants that the job is ready for final inspection. The Chief Electrical Inspector or his assist- ants shall schedule the inspection for the following workday or as soon as conditions permit. If the electrical inspector finds the installation has been constructed in accordance with the rules and requirements of this code he shall record approval of inspection on the appropriate form pro- vided by the Central Codes Enforcement Division. Such approval shall state the name of the inspector and date of inspection. 2. When final inspections are requested, it will be necessary for the electrical contractor to arrange for the structure or structures to be inspected to be open in order that the inspection can be made. Occupied structures or struc- tures containing personal property will not be entered by inspector unless accompanied by owner or owner's representative. I. Section 12 -6 is hereby amended to read as follows: Board of Electrical Examiners and Appeals - Composition; duties in general (a) There is hereby established a board of five members to be known as the Board of Electrical Examiners and Appeals. Such board shall be composed of personnel having the following qualifications: 1. Master Electrician, as licensed by this Chapter, that is not a principal in an electrical firm. 2. One Journeyman as licensed by this Chapter, 3. One Electrical Engineer as licensed by State Law that is a consulting engi- neer. 4. One shall be a representative of the Insurance Services Office of Arkansas. 5. One member shall be an electrical contractor duly licensed to do business in the City of Little Rock. (b) The board shall have the power and it shall be the duty of the board to hear and act on appeals of decisions of the Chief Electrical Inspector and to examine into the qualifications of all persons,firms, or corporations who are engaged in the business of contracting, for the installing of electric wiring, lighting fixtures, or apparatus as regulated by this code. -7- J. Section 12 -7 is hereby amended to read as follows: Same - Appointment; terms, vacancies; officers. (a) The members of the board shall be appointed by the City Manager subject to the approval of the Board of Directors. The terms of the members srall'be for three years and until their successors are appointed and qualified. Vacancies for any unexpired term shall be filled in the same manner as herein provided for by the original appointment of members. The original board authorized by the ordinance shall serve staggered terms to be determined by lot at the first meeting in ac- :. cordance with the following schedule; (a) one member for a one year term, (b) two members for two year terms, and (c) two members for three year terms. (b) The board shall select one of its members as Chairman and promulgate such rules and regulations for the conduct of its meetings as may be appropriate. / (c) The Chief Electrical Inspector shall act -as secretary for the board. f R. Section 12 -8 is hereby amended to read as follows: Same - Quorum; meetings; monthly report; rules and regulations; list of licenses. (a) A majority of the Board shall constitute a quorum to transact the business thereof. The Board shall meet at least once a month and may hold special meetings upon call of the chairman whenever the business of the board requires it. The books, papers and records of the board shall at all times be open and subject to inspections. The chairman shall file a report with the City Manager on or before the fifteenth of each month, setting forth the acts and doings of the board for the preceding month. (b) Any member of the board may be removed by the City Manager for in- competency, inefficiency or dereliction of duty. The board of electrical examiners and appeals shall adopt such rules and regulations for the examination of all applicants for license and for the conduct of the business of the board as may be necessary, not in conflict with the laws of the State of Arkansas, the provisions of this article or any ordinance which may hereafter be passed, and shall have the power to change and amend the same, subject to this limitation. A copy of any rules and regulations adopted before becoming effective shall be approved by the City Manager and filed with the City Clerk. A complete list of all licenses issued, renewed or revoked shall be on file in the office of the Chief Electrical Inspector. L. Sect] 12 -9 is hereby repealed in its entirety and the following new section 12 -9 substituted therefor: Appeals; time limit. (a) Whenever the Chief Electrical Inspector shall reject or refuse to approve the mode or manner of electrical construction proposed to be followed, or materials to be used in the erection or alteration of a building or structure, or when it is claimed that the provisions of this code do not apply, or that an equally good or more desirable form of construction can be employed in any specific case, or when it is claimed-that the true intent and meaning of this code or any of the regulations thereunder have been misconstrued or wrongly interpreted, the owner of such building or structure, or his duly authorized agent, may appeal from the decision of the Chief Electrical Inspector to the Board of Electrical Examiners and Appeals. Notice of appeal,sha:t.l be in writing and filed within 30 days after the decision is rendered by the Chief Electrical Inspector. WM (b) In case of an electrical installation which, in the opinion of the Chief Electrical Inspector, is unsafe or dangerous, the Chief Electrical Inspector may, in his order limit the time for such appeals to a shorter period. Appeals hereunder shall be on forms provided by the Chief Electrical Inspector. M. Section 12 -10 is hereby repealed in its entiretly and the following new Section 12 -10 substituted therefor: Decisions of the Board of Electrical Examiners and Appeals; variations and modifications. (a) The Board of Electrical Examiners and Appeals when so appealed to and after a hearing, may vary the application of any provisions of this code to any particular case when, in its opinion, the enforce- ment thereof would do manifest injustice, and would be contrary to the spirit and purpose of this code or public interest, or when, in its opinion, the interpretation of the Chief Electrical Inspector should be modified or reversed. (b) A decision of the Board of Electrical Examiners and Appeals to vary the application of any provision of this code or to modify any order of the Chief Electrical Inspector shall specify in what manner such variation or modification is made, the conditions upon which it is made and the reason therefor. N. Section 12 -11 is hereby repealed in its entirety and the following new Section 12 -11 substituted therefor. Decisions (a) Every decision of the Board of Electrical Examiners and Appeals shall be final, subject, however, to such remedy as -any aggrieved party might have at law or in equity. It shall be in writing and shall indicate the vote upon the decision. Every decision shall be promptly filed in the office of the Chief Electrical Inspector and shall be open to pt�blic inspection; a certified copy shall be sent by mail or otherwise to the appellant and a copy shall be kept publicly posted in the office of the Chief Electrical Inspector for two weeks after filing. (b) The Board of Electrical Examiners and Appeals shall, in every case, reach a decision without unreasonable or unnecessary delay. (c) If a decision of the Board of Electrical Examiners and Appeals reverses or modifies a refusal, order, or disallowance of the Chief Electrical Inspector, or varies the application of any provision of this code, the Chief Electrical Inspector shall immediately take action in accordance with such decision. 0. Section 12 -12 is hereby repealed in its entirety and the following new Section 12 -12 substituted therefor. Examinations and license required; penalty for violations. (a) No person, member, and /or employee of a firm or corporation shall engage in the electrical business of installing, altering, or repairing any electrical wiring, fixtures, devices or equipment in the city unless such persons, members, and /or employees of a firm or corporation have been duly examined and have been issued a license to engage in such business, such license to have been issued by the Board of Electrical Examiners and Appeals.. Permits to perform electrical work shall be issued by the Chief Electrical Inspector only to such persons, members, and /or employees of a firm or corporation holding such licenses. WE (b) Any person, member and /or employee of a firm or corporation in the city doing electrical work covered by this chapter of holding himself or itself out as licensed to do electrical work or engage in the electrical business of any one or more branches of the electrical industry as hereinafter defined without first successfully passing an examination given by the Board and securing a license in the manner hereinafter set forth shall, upon conviction thereof, be guilty of a misdemeanor. P. Section 12 -13 is hereby repealed in its entirety and the following new Section 12-13 substituted therefor. Examinations; application; fee; issuance of license; renewal (a) Every person, member, and /or employee of a partnership firm of cor- poration desiring to engage in the electrical business as heretofore defined shall, before engaging in such business, successfully pass an examination, prepared, conducted,,.--and held by the Board of Electrical Examiners and Appeals. All applicants desiring to take such examinations shall apply in writing to the secretary of the Board at least ten days before the scheduled board meeting and shall file such information as may be required by the board to determine the qualifications of said applicant. The information available from the application and subsequent investigation shall be considered by the board at its regularly scheduled meeting. Those applicants meeting the requirements as established by the board shall be given the privilege to take the examination on the following scheduled meeting. The applicant shall pay to the City Collector an examination fee in the sum as hereinafter set forth and shall exhibit a receipt for such fee to the secretary of the Board of Electrical Examiners and Appeals before he shall be allowed to take such examination. The board shall fix the time and place for the examination of applicants, and if the board shall find upon examination that any applicant has a reasonable knowledge of the natural and practical laws and functions of electricity, the safe, correct and approved manner of installing devices, apparatus, and instrumentalities for electric light, heat, power and signaling purposes, and the ordinances of the City of Little Rock governing the installation of electrical devices, apparatus and instrumentalities, then the board shall issue to such person the license for which he has applied, which license shall indicate thereon his qualifications and the fact that he has successfully completed and passed the examination given by the board for his particular type of electrical work. All such licenses shall expire on the thirty -first day of December of each year. All duly licensed persons who apply for such licenses within thirty -one days after the expiration date shall pay the fee hereinafter mentioned for renewal. (b) If such renewal is not applied for on or before the thirty -first day of January succeeding the period of the license, a penalty of five dollars ($5.00) will be assessed in addition to the regular renewal fee. If the license is not renewed by June 30, the applicant shall be reexamined.by the board and shall be required to pay the examination fees for such examination as hereinafter prescribed. Q. SectionL2 --14 is hereby repealed in its entirety and the following -new Section 12 -14 substituted therefor. Classification and qualifications of applicants. The classifications of the various branches of the electrical industry and qualifications required of applicants shall be as follows: (a) Master Electrician. 1. A Master electrician shall be defined to include any individual who possesses the necessary qualifications, training and technical knowledge to plan, lay out and supervise the installation, maintenance and ex- tension of electrical conductors and equipment. 2. He shall be a person of not less than twenty -one years of age and a person of good moral character. 3. He must be a graduate electrical: engineer from a recognized university or college, with at least one year actual experience in- stalling wires, conductors, and electrical equipment used inside of buildings for the transmission of electrical current for light, heat or power purposes, or, -10- 4. He shall have had at least six years exper.ieoce working for a licensed electrical contractor, two years of which were as a, journeyman. installing wires, conductors and electrical equipment used inside of buildings for the transmission of elec- trical current for light, heat or power purposes. This experience shall be within the last 10 years. 5. Examination fee for master el.ectriciari shall be ..... $15.00 Renewal fee for master electrician shall be .,.,, 7.50 (b) Journeyman electrician. 1. Journeyman electrician shall be deEin.ud to include any i.n.dividual who possesses the necessary qualifications,, training, technical knowlege to install, maintain and extend electrical conductors and equipment; further, he shall be capable of doing such work in accordance with pi.a.ns and specifications furnished him in accordance with standard rules and regulations governing such work. 2. He shall have had at least four years experience working for a licensed electrical contractor installing wires, conductors and electrical equipment used inside build- ings for the transmission of electrical. current for electrical. light p heat or power purposes. Electrical. contractor shall be defined to include any person, member., and/or em- ployee of a .firm, partnership, or corporation engaged in the business of instal- ling, erecting or repairing or contracting to install., erect, or repair electric wires or conductors to be used for the transm-i.ssion of electric light, heat or power purposes or to install or repair moulding, ducts, raceways or conduit for the reception or protection of such wires or conduits, or any electrical machinery, apparatus, or systems to be used for electrical light, heat, power or signalling purposes. Any person, member, and. /or employee of a. firm partnership, or corpora- tion engaged in the business of installing electrical wiring or equipment of alarm or signal systems of less than 30 volts'shal.l -not be required to employ a licensed electrician but shall be required to take permits, provide for inspections, and be bonded as required by this ordinance. They sha.l.l be classified as signal con- tractors and shall file with the secret_a.ry of the Exam'i.-I. Electrical refrigeration repair contractor shall be defined to include any person, firm, partnership, or corporation engaged in the business of repairing, or maintaining electrical equipment in connection with refrigeration. They shall not be entitled to make electrical wiring installation in connection with refrigeration for light or power, neither can they make installation connections to commercial or domestic units, except domestic units of the portable plugin type. Actual work shall be done by a qualified master, journeyman, or specialist refrigeration electrician. Electrical refrigeration repair contractor shall pay a license fee of fifty dollars annually on -nor before the thirteeneth day of January of each year for the privilege of engaging in such business. (j) Electrical sign contractor. 1. Electrical sign contractor shall be defined to include any person, firm, partnership or corporation engaged in the business of manufacture, installation, erection and repair of electrically illuminated or operated signs. They shall be entitled to install, repair, and maintain electrical equipment and wiring within the sign enclosure or structure and make supply connection provided there is an approved outlet= of sufficient capacity available within fifteen feet of the sign to be connected. Electrical work shall be done by a master, journeyman or a specialist sign electrician. 2. Electrical sign contractors shall pay a license fee same as electrical contractor. R. Section 12 -15 is hereby repealed in its entirety and the following new Section 12 -15 substituted therefor. Electrical contractor; bond. Every person, firm or corporation doing business in the City as a licensed Electrical contractor bhall file with the Chief Electrical Inspector a bond in the penal sum of two thousand dollars with a recognized surety company, authorized to do business in the City. The bond and surety shall be approved by the City Attorney, the condition of said bond being that the City of Little Rock, or any citizen of said city damaged by improper electrical work; and conditioned further that the principal shall strictly comply with the ordinances of the city governing such work; that the principal will do or suffer no work to be done without a permit, and will report work done for inspection in conformity with the laws and ordinances of the city. S. Section 12 -16 is hereby repealed in its entirety and the following new Section 12 -16 substituted therefor. License - Nontransferable; revocation; unlawful to operate without. (a) No license certificates issued by said board shall be assignable or transferable. Any license issued may be suspended or revoked by the board for any violation of the terms of this chapter or any ordinance governing the installation or inspection of electrical work, or any rules and regulations promulgated by the board after a hearing to be held at the convenience of the board. (b) It shall be unlawful for any person, firm, partnership or corporation licensed under this article, to do any electrical work covered by this chapter, after the expiration of the license issued, or after the revocation or suspension of such license or to perform any such work without a valid license from the city. -13- T. Section 12 -17 as contained herein is hereby repealed in its entirety and a new Section 12 -17 is set out as follows: Same - Display. Every person, firm or corporation licensed under this article shall display such license in his or its place of business. U. Section 12 -18 is hereby repealed in its entirety and the following new Section 12 -18 substituted therefor. Same - Fraud in connection with. It shall be unlawful for any person, firm or corporation licensed under this article to alter, transfer, lend or rent his or its license certificate or use a license not his or its own. It shall also be unlawful for any person to falsely represent himself or themselves to be licensed under this article, or to wrongfully use a license issued by said board. V. Section 12 -19 is hereby repealed in its entirety and the following new Section 12 -19 substituted therefor. Issuance of permits limited to licensees. (a) The Chief Electrical Inspector is hereby prohibited to issue electrical construction permits to any person, firm or corporation other than those licensed under this article except in the event said person, firm or corporation has a permanent employee who is a licensed journeyman electrician to install or maintain electrical wires or apparatus in or upon their own premises. (b) A permit may be issued to a property owner to do work in his own home provided he has a current master or journeyman electrician's license with the City of Little Rock or can submit sufficient proof that he possesses the knowledge and experience to such a degree that he is capable of wiring his own home according to this code, and can show proof that he owns the home, is presently residing, or will reside in the structure after completion. All electrical work shall be done by the applicant. Prior to the issuing of an electrical permit the applicant must submit in writing a statement containing his name, current address, telephone number, and agreement to comply with the applicable provisions of this code. (c) A fee of $5.00 will be assessed to each applicant applying for certification by the Board of Electrical Examiners and Appeals. W. A new Section 12 -20 is hereby provided to read as follows: Exemptions of public utilities. Nothing in this article shall be construed or interpreted as applying to any firm or corporation, or employee thereof, engaged in providing communication facilities to the public through a central offfice operated by it, or a firm or corporation or employees thereof engaged in the generation of electric current for distributing electric energy for light, heat, or power, or electrically operated transportation. A new Section 12 -21 is hereby provided to read as follows: Penalty for violations. Any person violating any of the provisions of this article shall, upon conviction thereof, be deemed guilty of a misdemeanor and shall be fined not less than fifty dollars nor more than three hundred dollars and each day of such violation shall constitute separate offense, (Ord. No. 7222, Sec. 14, 3- 24 -47). 1 -14- Y. A new Section 12 -22 is hereby provided to read as follows: Recognition of Electrical License. The City of Little Rock, Arkansas will recognize the licenses of master or journeyman electricians from other cities within the State of Arkansas provided the following criteria is met: 1. An electrical examining board has been duly appointed by each local governing body to examine the qualifications of applicants for electricians license equivalent to those required by this code. 2. A regular system of inspection of electrical construction is maintained by the municipality to assure compliance with the National Electrical Code and Sections 12 -1 and 12 -2 of this or equivalent code. 3. The installation of electrical materials, devices, equipment or related items conforms to the requirements of the National Electrical Code except as modified by Section 12 -1 of this Code. 4. The governing body has given written notice to the City of Little Rock that the conditions stipulated within this ordinance are acceptable. A local code which meets the approval of participating member cities may be accepted in lieu of this ordinance. 5. Written verification of license has been given by the electrical inspector of the applicant's home town to the electrical inspector of the city where application for license is made. 6. The examining board of each local government has the authority to refuse or revoke the license of any person or firm to operate with- in their jurisdiction when that person or firm does not display skill, knowledge or craftsmanship deemed necessary to properly comply with the accepted standards. 7. That cooperation of examining boards of association member cities will assure that action will be taken by the city where the license holder has his primary license if violation of accepted standards are to the degree that remedial action is warranted. Z. A new Section 12 -23 is hereby provided to read as follows: 1. 2. AA. Recognition of out -of -state license. Master or journeyman license issued in other states may be recognized and honored by the City of Little Rock upon submission of adequate proof of qualification as may be deemed necessary by the Board of Electrical Examiners. The Board of Electrical Examiners may authorize the Chief Electrical Inspector to investigate and evaluate the in- formation submitted by out -of -state applicants. The qualifications of the out -of -state master . or journeyman electrician shall in no case be less than those required by the reciprocal licensing provision in Section 12 -22 of this ordinance. A new Section 12 -24 is hereby provided to read as follows: Individuals or firms desiring to obtain a license under conditions stipulated in Section 12 -22 must have acceptable license in the City where they have an established residence or business. Each firm operating as an electrical business or anyone desiring to obtain a contractor's license must possess a valid master electrician license of the city in which he lives or operates an office. BB. -15- A new Section 12 -25 is hereby provided to read as follows: Validity If any provisions of those ordinances, constituting the Little Rock Electrical Code or the application thereof to any circumstance is held invalid, the remainder of the electrical code, or the application of the provision to other circumstances shall not be affected thereby. If any part of the electrical code is adjudged to be invalid, such judgment shall not invalidate the remainder of the electrical code but shall be confined in its effect solely to the part directly in- volved in the proceeding in which rendered.
