AN ORDINANCE AMENDING ORDINANCE NO 12,745 TO
PROVIDE FOR THE INCLUSION OF SECTION 2, WHICH
SECTION PROVIDES FOR UTILITY EASEMENTS, RIGHTS
AND INTERESTS; AND FOR OTHER PURPOSES
WHEREAS, a Petition was filed with the Board of Directors
of the City of Little Rock, Arkansas on the 6th day of December,
1972 asking that the Board of Directors vacate and abandon the
alley which runs north and south in the middle of Block 41,
Original City of Little Rock, said alley abutting on the East
sides of Lots 1 through 6, and on the West sides of Lots 7 through
12 of said Block; and
WHEREAS, the ordinance closing the described alley was
deficient in that provision was not made for retention of
utility rights and interests.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS.
SECTION 1. Ordinance No. 12, 745 passed by the Board of
Directors on February 20, 1973 is hereby amended to add a
Section 2, which section reads as follows:
"SECTION 2. That the rights now held by any public
utility company under the laws of the State of Arkansas
or under grants heretofore made by the City of Little
Rock to use the street and alley as described above
for the location and operation and maintenance of lines
and facilities for the furnishing of public utility
services shall not be abrogated, diminished or changed
by the passage of this ordinance and any utility easements
now in effect are specifically excepted from this closing."
SECTION 2. A copy of this ordinance duly certified by the
City Clerk shall be filed in the office of the Recorder for
Pulaski County and recorded in the Deed Records of the County.
SECTION 3. This Ordinance shall be in full force and
effect from and after its passage.
