HomeMy WebLinkAbout13137i ORDINANCE NO. 13,137 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS VACATING, ABANDONING AND CLOSING THAT PORTION OF THE NORTH -SOUTH ALLEY LOCATED WITHIN BLOCK 5, COX'S SUBDIVISION OF TAYLOR & BODEMAN ADDITION TO THE CITY OF LITTLE ROCK, WHICH PORTION IS LOCATED BETWEEN LOTS 4, 5 AND 6, AND LOTS 7, 8 AND 9, COX'S SUB- DIVISION OF TAYLOR & BODEMAN ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a Petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 3rd day of December 1975, asking the Board of Directors to vacate and abandon that portion of the North -South alley located within Block 5, Cox's Subdivision of Taylor & Bodeman Addition to the City of Little Rock, which portion is located between Lots 4, 5 and 6, and Lots 7, 8 and 9, Cox's Subdivision of Taylor & Bodeman Addition to the City of Little Rock, as described below, which portion of said North -South alley is more particularly described in Plat and Bill of Assurance dated June 26, 1906 and appearing of record in Pulaski County, Arkansas, Plat Book No. 1 at page 24, in the office of the Recorder of Pulaski County, Arkansas; and WHEREAS, after due notice, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the portion of the North - South alley described below has heretofore been dedicated to the public use as an alley; that all of the owners of property abutting upon that por- tion of the North -South alley to be vacated, abandoned and closed have filed with the Board of Directors written consent to such vacation, abandon- ment and closing; that said portion of the North -South alley as described below is no longer needed or required for corporate purposes or for use by the general public or by adjoining owners and accordingly the public interest and welfare will not be adversely affected by the closing of said portion of the North -South alley described below; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS; 6 04 —�° Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to that portion of the North -South alley located within Block 5, Cox's Subdivision of Taylor & Bodeman Addition to the City of Little Rock, which portion is located between Lots 4, 5 and 6, and Lots 7, 8 and 9, Cox's Subdivision of Taylor & Bodeman Addition to the City of Little Rock, more particularly described in Plat and Bill of Assurance dated June 26, 1906 appearing of record in Pulaski County, Arkansas Plat Book No. 1 at page 24 as follows: That portion of the North -South alley located within Block 5 of Cox's Subdivision of Taylor & Bodeman Addition to the City of Little Rock, Arkansas, des- cribed as: Beginning at the Southwest corner of Lot 6, Block 5, Cox's Subdivision of Taylor & Bodeman Addition to the City of Little Rock; run thence North along the East right of way line of the North -South alley to the Northwest corner of Lot 4, Block 5, Cox's Subdivision of Taylor & Bodeman Addition to the City of Little Rock; run thence West 10 feet to the Northeast corner of Lot 9, Block 5, Cox's Subdivision of Taylor & Bodeman Addition to the City of _Little Rock; run thence South along the West boundary line of said North -South alley to the Southeast corner of Lot 5, Block 5, Cox's Subdivision of Taylor & Bodeman Addi- tion to the City of Little Rock; run thence East 10 feet to the point of beginning, subject, however, to any public utility easements located therein. Section 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas and recorded in the Deed Records of the County.
