ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS, VACATING AND ABANDONING
A PORTION OF MERRILL DRIVE BETWEEN RODNEY PARHAM
ROAD AND RAINWOOD ROAD, LITTLE ROCK, ARKANSAS
WHEREAS, a petition was duly filed with the Board of Directors of the
City of Little Rock, Arkansas, on the 21st day of January , 1977, asking
the Board of Directors to vacate and abandon a portion of Merrill Drive between
Rodney Parham Road and Rainwood Road, as designated on the plat of
Berkshire Park Horizontal Property Regime now appearing of record in Plat Book
31 Pages 18 & 19,in the office of the Recorder of Pulaski County, Arkansas, and
WHEREAS, after due notices as required by law, the Board of Directors has,
at the time and place mentioned in the notice, heard all persons desiring to be heard
on the question and has ascertained that the lands hereinafter described, have
heretofore been dedicated to the public use as a street but has never been used by
the public; and that public interest and welfare will not be adversely affected by
the abandonment of such lands;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and
abandons all its rights, together with the rights of the public generally, in and to
the lands designated as follows:
The East 20" of Ri ght -of -Way of Merrill Drive as recorded on the Final Plat
of Berkshire Park Horizontal Property Regime, Being a Part of the NJ NI,
Section 33, T -2 -N, R -13 -W, Little Rock, Pulaski County, Arkansas as
recorded in Plat Book 31 pages 18 & 19 filed for record May 25, 1973, more
particularly described as:
Beginning at the Southwest corner of Lot 2, Tract "A, " a Part of Charles
Valley :subdivision as recorded in Plat Book 31 Page 98, filed for record
August 9, 1973; thence S15017'31 "W 196.41' to the point of curvature of
a 1105.92' radius curve to the left; thence along said curve with a chord
bearing and distance of S 01035' 31 "W 523.86' to the point of tangency
thereof; thence S 12006' 30 "E 238.47' to the point of curvature of a 532.96'
Radius curve to the left; thence along said curve with a chord bearing
and di;;tance of 515018'54 "E 59.63' to a point; thence S71028'41 "W 20.0';
thence along a 552.96' Radius curve to the right having a chord bearing and
distance of N15019101 "W 61.86' to the point of -tangency thereof; thence
N12006' 30 "W 238.47' to the point of curvature of a 1125.92' Radius curve
to the right having a chord bearing and distance of N01035'31 11E 533.33' to
the point of tangency thereof; thence N21006127 11E 197.43' to the point
of beginning, containing 0.4278 Acres more or less.
subject, however, to any public utility easements located in said lands.

SECTION 2. A copy of this Ordinance, duly certified by the City Clerk,
shall be filed in the office of the recorder of Pulaski County and recorded in the
Deed Records of the County.
SECTION 3. This Ordinance shall take effect and be in force from and
after its passage.
