LUCIE AVENUE, AND THE ALLEY RIGHT -OF -WAY WITHIN
BLOCK 21, C.O. BRACK ADDITION TO THE CITY OF LITTLE
ROCK, ARKANSAS; AND FOR OTHER PURPOSES.
WHEREAS, a request was made to abandon that portion of Anna Street right -of -way between West
32 "d Street and Lucie Avenue, being approximately 305 linear -feet, and the alley right -of -way within
Block 21, C.O. Brack Addition, being approximately 237.5 linear -feet, to the City of Little Rock,
Arkansas, pursuant to the City's general police power authority under Ark. Code Ann. § 14 -54 -104; and
WHEREAS, the Board has determined that the abandonment of the Anna Street right -of -way and the
alley right -of -way will not have an adverse impact on the adjacent property owners or the public welfare
and safety;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. The Board of Directors hereby releases, vacates, and abandons that portion of Anna Street
right -of -way between West 32 "d Street and Lucie Avenue, being approximately 305 linear -feet, and the
alley right -of -way within Block 21, C.O. Brack Addition, being approximately 237.5 linear -feet, subject
to the following conditions:
1. Both areas of abandonment will be retained as utility and drainage easements.
2. Compliance with the Public Works Department comments as noted in paragraph A of the staff
report.
3. Compliance with the Little Rock Fire Department comments as noted in paragraph I of the staff
report.
Section 2. The City specifically reserves any required public utility and drainage easements.
Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part

of the ordinance.
Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
