HomeMy WebLinkAbout13373r ORDINANCE NO. 13,373 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE ALLEY IN PROSPECT TERRACE ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 6th day of September, 1977, asking the Board of Directors to vacate and abandon an Alley or Driveway Easement on the Plat of Prospect Terrace Addition to the City of Little Rock, as designated on the plat of said Addition now appearing of record in Deed Book 2, Page 159, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easements in said alley; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the alley, hereinbefore described, has heretofore been dedicated to the public use as an alley, as herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the alley to be vacated have filed with the Board of Directors their written consent to such abandon- ment; /and that public interest and welfare will not be adversely affected by the abandon- ment of such alley; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the alley designated as follows: All that part of an Alley or Driveway Easement shown on the Plat of Prospect Terrace, Additions to the City of Little Rock, Arkansas, which lie between Lots 88 and 89, Prospect Terrace on the South and Lots 78 and 77, Prospect Terrace, and Lot 175, Prospect Terrace No. 2 on the North, subject, however, to any public utility easements located in said alley. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3.
