AN ORDINANCE PERMITTING THE LITTLE ROCK POLICE
DEPARTMENT AND THE LITTLE ROCK FIRE DEPARTMENT
TO ENTER, LIMIT AND CONTROL THE AREAS ADJACENT
TO THE UNIVERSITY MALL SHOPPING CENTER,LOCATED
AT THE NORTHWEST CORNER OF CAPITOL AND UNIVER-
SITY AVENUES; APPROVING PLAN OF THE AREA SHOW-
ING THE LIMITATIONS AND CONTROLS;PROVIDING FOR
THE INSTALLATION OF DEVICES AND SIGNALS; AND
FOR OTHER PURPOSES.
WHEREAS, M. S. Management Associates Inc., the authorized
representatives of the owners of the University Mall located at
Capitol and University Avenues, Little Rock, Arkansas, have re-
quested in accordance with Act 472 of 1973 that the City of Little
Rock enact an ordinance providing for the enforcement of limita-
tions and controls of the use of areas under their control adjacent
to the aforesaid shopping center and commercial enterprises which
are maintained for the convenience of the public so as to provide
ingress and egress, loading and unloading areas, fire lanes, park-
ing spaces and other measures for the safety and convenience of
the public; and,
WHEREAS, M. S. Management Associates Inc. has presented a
plan of the area under their control identifying that portion of
said property which is privately owned but which is maintained for
the convenience of the public so as to provide ingress and egress,
loading and unloading areas, fire lanes, parking spaces, and other
measures for the safety and convenience of the public; and,
WHEREAS, M. S. Management Associates Inc., upon the passage
of this ordinance has agreed and is hereby further committed to
providing, at its expense, signs, painted lines, arrows, curbings
in the required colors, devices and signals to appraise the public
of the existence of this ordinance.
THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
SECTION 1. The plan submitted by the management of University
Mall is hereby approved and accepted, said plan shall be kept on file
by the City Clerk of the City of Little Rock, the Little Rock Police
Department and the Little Rock Fire Department. That said plan shall
limit and control the use of the areas adjacent to the subject shop-
ping center which are maintained for the convenience of the public as
ingress and egress, loading and unloading areas, fire lanes and parking
spaces.
SECTION 2. The City of Little Rock shall not be required by
this ordinance to patrol any such area which is identifiedin the
plan which is herein approved and attached hereto as "Exhibit 1"
and made a part hereof as if set out herein; however the City of
Little Rock may patrol said areas and issue citations for viola-
tions of said plan as hereinafter provided.
SECTION 3. Upon request of any person in writing, duly autho-
rized officers of the Little Rock Police Department shall issue
citations or arrest any person violating the provisions of this
ordinance. Nothing herein shall be construed so as to limit the
authority of the City of Little Rock to enter and patrol the sub-
ject pigmises and issue citations or effect the arrest of any offender
if said offense is committed or is in existence in the presence of
the officer.
SECTION 4. M. S. Management Associates Inc. shall maintain
all signs, markings, curb colorings, signals and devices at its
own expense and further maintain same so as to be legible, clear
and visible. The City of Little Rock Traffic Engineer is hereby
authorized to make inspections of said signals, signs, paintings
or other devices and notify M. S. Management Associates Inc. of
any deficiencies found therein and upon written notice from the
City of Little Rock Traffic Engineer or his dulyauthorized repre-
sentative, shall within thirty (30) days accomplish the necessary
repairs, improvements or corrections as to accomplish the intent
and purpose of this ordinance.
SECTION 5. Hereafter, any person, firm or corporation who
violates any of the provisions of this ordinance shall be charged
with a misdemeanor and upon conviciion shall be fined not less
than $5.00 or more than $50.00.
SECTION 6. This ordinance is in full force and effect from
and after the date of its passage and approval.
