ORDINANCE OF THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING
THE ALLEY IN BLOCK 3, PERRY HEIGHTS ADDITION
TO THE CITY OF LITTLE ROCK, ARKANSAS
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas, on the 5th
day of July, 1977, asking the Board of Directors to vacate
and abandon part of the alley in Block 3, Perry Heights
Addition to the City of Little Rock, as designated on
the plat of said Addition now appearing of record in Plat
Book 1, Page 27, in the office of the Recorder of Pulaski
County, Arkansas, subject, however, to any public easements
in said alley; and
WHEREAS, after due notices as required by law, the
Board of Directors has, at the time and place mentioned
in the notice, heard all persons desiring to be heard on
the question and has ascertained that the alley, herein -
before described, has heretofore been dedicated to the public
use as an alley, as herein described; has not been actually
used by the public generally for a period of at least five (5)
years subsequent to the filing of the plat; that the owner
of the property abutting upon the alley to be vacated has
filed with the Board of Directors its written consent to such
abandonment; and that public interest and welfare will not
be adversely affected by the abandonment of such alley;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its rights, together with
the rights of the public generally, in and to the alley
designated as follows:
A tract of land in Block 3, Perry
Heights Addition to the City of Little
Rock, described as:
Beginning at the Southwest corner of
Lot 1, thence West 12 feet, more or
less, to the Southeast corner of Lot 12,
thence North 46.8 feet, more or less, to
• the Northeast corner of Lot 12, thence
East 12 feet, more or less, to the North-
west corner of Lot 1, thence South 46.8
feet to the point of beginning, LESS AND
EXCEPT that portion of said described
alley lying within the right of way of
the Wilbur D. Mills Expressway.
subject, however, to any public utility easements located
in said alley.
SECTION 2. A copy of this Ordinance, duly certified
by the City Clerk, shall be filed in the office of the
Recorder of Pulaski County and recorded in the Deed Records
of the County.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage.
