OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING A PORTION OF EAST 5TH STREET BETWEEN BLOCKS 16 AND 17, GARLAND ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas on the 16th day of June, 1977, asking the Board of Directors to vacate and abandon -all of East 5th Street be- tween Blocks 16 and 17, Garland Addition to the City of Little Rock, as designated on the plat of said Addition now appearing of record in Plat Book "Y ", Page 37, in the office of the Chancery Court of Pulaski County, Arkansas, subject, however, to any public easements in said street; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street hereinbefore described has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the street to be vacated have been filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: East 5th Street, bounded on the north and south by Blocks 16 and 17, respectively, Garland Addition to the City of Little Rock, and on the West by the Missouri Pacific Railroad Right -of -Way and on the East by the Right -of -Way of Pepper Street extended, subject, however, to any public utility easements located in said street. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. v -2- SECTION 3.
