HomeMy WebLinkAbout13328rt� ORDINANCE NO. 13,328 ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THAT PORTION OF BLUNT STREET LYING BETWEEN BLOCKS 1 AND 4, OAK PARK ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS; THAT PORTION OF 39TH STREET LYING BETWEEN BLOCKS 1 AND 2, OAK PARK ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS; AND THAT PORTION OF LEYMER STREET LYING EAST OF BLOCKS 1 AND 2, OAK PARK ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a Petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 15th day of June , 1977, asking the Board of Directors to vacate and abandon that por- tion of Blunt Street lying between Blocks 1 and 4, Oak Park Addi- tion to the City of Little Rock, Arkansas; that portion of 39th Street lying between Blocks 1 and 2, Oak Park Addition to the City of Little Rock, Arkansas; and that portion of Leymer Street lying East of Blocks 1 and 2, Oak Park Addition to the City of Little Rock, Arkansas, as designated on the plat of said Addition now appearing of record in Plat Book 1, Page 230, and Book 528, Page 389, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easements in said streets; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the streets, hereinbefore described, have heretofore been dedi- cated to the public use as streets, as herein described; have not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat; that all of the owners of the property abutting upon the streets to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such streets; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the streets designated as follows: That portion of Blunt Street lying between Blocks 1 and 4, Oak Park Addition to the City of Little Rock, Arkansas; that portion of 39th Street lying between Blocks 1 and 2, Oak Park Addition to the City of Little Rock, Ark- ansas; and that portion of Leymer Street lying East of Blocks 1 and 2, Oak Park Addition to the City of Little Rock, Arkansas, subject, however to any public utility easements located in said streets.
