ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS, VACATING ANC CLOSING THE 20' ALLEY
BETWEEN LOT 179, PROSPECT TERRACE NO. 2 AND LOT 180,
PROSPECT TERRACE NO. 3 BOTH BEING ADDITIONS TO THE CITY
OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of Directors of
the City of Little Rock, Arkansas, on the 28th day of April 1978 ,
asking the Board of Directors to vacate and abandon all of the 20' alley between
Lot 179, Prospect Terrace No. 2 and Lot 180, Prospect Terrace No. 3, both being
Additions to the City of Little Rock, as designated on the plats of said Additions
now appearing of record in Plat Book 3, Pages 39 and 52, in the office of the
Recorder of Pulaski County, Arkansas, subject, however, to any public easements
in said alley; and
WHEREAS, after due notices as required by law, the Board of Directors
has, at the time and place mentioned in the notice, heard all persons desiring
to be heard on the question and has ascertained that the alley hereinbefore described,
has heretofore been dedicated to the public use as a alley, as herein described;
has not been acutally used by the public generally for a period of at least five
(5) years subsequent to the filing of the plat; that all of the owners of the
property abutting upon the alley to be vacated have filed with the Board of Directors
their written consent to such abandonment; and that public interest and welfare
will not be adversely affected by the abandonment of such alley;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates
and abandons all its rights, together with the rights of the public generally, in
and to the alley designated as follows:
A 20' wide alley located between Lots 179, Prospect Terrace No. 2 and
Lot 180, Prospect Terrace No. 3, both being Additions to the City of Little Rock,
Arkansas subject, however, to any public utility easements located in said alley.
SECTION 2. A copy of this Ordinance, duly certified by the City Clerk,
shall be filed in the office of the Recorder of Pulaski County and recorded in the
Deed Records of the County.
SECTION 3. This Ordinance shall take effect and be in force from and
after its passage.
