ORDINANCE NO. 13,395
AN ORDINANCE AUTHORIZING THE CONSTRUCTION, USE,
OCCUPATION AND MAINTENANCE OF OVERHEAD STRUCTURES
OVER 9TH STREET BETWEEN BATTERY & WOLFE, OVER 9TH
STREET BETWEEN WOLFE AND MARSHALL AND OVER BATTERY
STREET BETWEEN 8TH AND 9TH; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS.
SECTION 1. The Arkansas Children's Hospital in Little Rock,
Arkansas, its successors and assigns, is hereby authorized to
construct, use, occupy and maintain overhead structures across
the following streets in the City of Little Rock and as reflected
on Exhibit "A" attached hereto containing 4 sheets:
(1) An overhead structure across Battery Street between
8th and 9th Streets as set forth and in keeping with the drawing
reflected on Area Plan "A" of Exhibit "A" attached hereto.
(2) An overhead structure across 9th Street between Battery
and Wolfe as set forth and in keeping with the drawing reflected on
Area Plan "B" of Exhibit "A" attached hereto.
(3) An overhead structure across 9th Street between Wolfe and
Marshall Streets as set forth and in keeping with the drawing re-
flected on Area Plan "C" of Exhibit "A" attached hereto.
SECTION 2. The overhead structures provided for in Section 1
hereof shall be constructed in accordance with plans and specifications
to be submitted to and approved by an authorized representative of
the City of Little Rock prior to the beginning of such construction.
SECTION 3. The City of Little Rock in granting this franchise
reserves the right to have all the overhead structures or any of
them removed at the cost and expense of the Arkansas Children's
Hospital its successors and assigns, if it ever becomes necessary
from the standpoint of public welfare that same be removed.
SECTION 4. This Ordinance shall be in full force and effect
from and after its passage.
