HomeMy WebLinkAbout13999ORDINANCE NO. 13,999 AN ORDINANCE VACATING AND CLOSING A PORTION OF GEYER STREET IN EAST VIEW TERRACE, ADDITION TO THE CITY OF LITTLE ROCK. WHEREAS, a petition was duly filed with the Board of Directors of the City of Little Rock, Arkansas, on the 17th day of February, 1981, asking the Board of Directors to vacate and abandon approximately 460 feet of Geyer Street between the North Right -of -Way line of 13th Street and the Northern terminus of Geyer Street between 13th Street and 10th Street, East View Terrace Addition to the City of Little Rock, as designated on the plat of said Addition now appearing of record in Plat Book 33, Page 17, in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any public easements in said street; and WHEREAS, after due notices as required by law, the Board of Directors has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the street, hereinbefore described, has heretofore been dedicated to the public use as a street, as herein described; that the closing of said street will enhance and benefit the health, safety, and welfare of the public and is in the public interest; that all of the owners of the property abutting upon the street to be vacated have filed with the Board of Directors their written consent to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION _1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, in and to the street designated as follows: Approximately 460 feet of Geyer Street extending Northward from the North Right -of -Way line of 13th Street to Northern terminus of Geyer Street between 13th Street and 10th Street in East View Terrace Subdivision. subject, however, to any public utility easements located in said street. SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County and recorded in the Deed Records of the County. SECTION 3. This Ordinance shall take effect and be in force from and after its passage.
