AN ORDIANC E VACATING AND CLOSING MC.'CUMS STREET
AND ALLEYS IN FACTORIA THIRD ADDITION OF THE CITY
OF LIT TIE ROCK.
WHEREAS, a petition was duly filed with the Board of Directors of the City of
Tittle Rock, Arkansas, on the 24 th day of December , 19 80 , asking the Board
of Directors to vacate and abandon all of MCCOMBS Street and Alleys, in Block
18 and 20 FACTORIA TRIM addition to the City of Little Rock, as designated on
the plat of said addition now appearing of record in Deed Book No. 1 , Page 248 ,
in the office of the Recorder of Pulaski County, Arkansas, subject, however, to any
public easements in said street; and
WHEREAS, after due notices as required by law, the Board of Directors has, at
the time and place mentioned in the notice, heard all persons desiring to be heard
on the question and has ascertained that the street and alleys, hereinbefore described,
has heretofore been dedicated to the public use as a street and alleys, as herein
described; has not been actually used by the public generally for a period of at least
five (5) years subsequent to the filing of the plat; that all of the owners of the
property abutting upon the street and alleys to be vacated have filed with the Board
of Directors their written consent to such abandonment; and that public interest and
welfare will not be adversely affected by the abandonment of such street.
NOW, THMMRE, BE IT ORDAINED BY THE BOARD OF DIRWMRS OF THE CITY OF LITTLE
ROCK, ARKANSAS.
SECTION 1. The City of Little Rock, Arkansas, hereby releases, vacates and
abandons all its rights, together with the rights of the public generally, in and
to the street and alleys designated as follows:
McCombs Street which lies between Blocks 18 and 20 and South of
East Roosevelt Road in Factoria Third Addition;
Alley between Lots 1 to 4 inclusive and Lot 5, Block 18;
Alley between Lots 3 and 4 and Lot 5, Block 20 and South of East
Roosevelt Road;
Alley between Lots 11, 12 and 13 and Lot 14, Block 20;
Alley lying south of Tilts 5 to 10 inclusive, Block 20 in Factoria
Third Addition.
SECTION 2. A copy of this Ordinance, duly certified by the City Clerk, shall
be filed in the office of the Recorder of Pulaski County and recorded in the Deed
Records of the County.
SECTION 3. This Ordinance shall take effect and be in force from and after its
passage.
