AN ORDINANCE PROVIDING FOR MODIFIED
STREET STANDARDS FOR DEDICATION OF
PRIVATE STREETS TO THE PUBLIC;
AMENDMENT OF THE SUBDIVISION RULES
AND REGULATIONS AND OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1. That Article V., Section 37.20 paragraph A.
be amended to provide for introduction of an additional paragraph
A.6, which shall read as follows:
A.6
For purposes of dedication of private streets to the
public for maintenance, the standards set forth in
Section 37.21.B.10. shall apply. All plats submitted
under this provision shall be reviewed with the
standards provided being minimums. A higher level
of improvements may be required as circumstances
warrant.
SECTION 2. That Article V. Section 37.21.B.9. be amended
to provide for the introduction of the word "new" as the first
word of the first sentence.
SECTION 3. That Article V. Section 37.21.B. be amended to
provide for the introduction of B.10. as follows:
B.10 PRIVATE STREETS - Existing private streets shall
be dealt with as follows for purposes of dedication:
1.) The Planning Commission of the City of Little Rock,
Arkansas shall in every instance be the final
authority.
2.) Principle Access Right -of -Way Only - Alley dedications
shall be discouraged.
3.) Streets and alleys which had been previously dedicated
to the County will become City streets upon annexation;
these streets and alleys will be ma%nta%ned at or
above their physical condition upon annexation.
4.) Streets and alleys which had been previously fully
maintained by the County for which no dedication is
o'n record will become City streets upon annexation
only if a formal dedication is made. Such dedications
shall be reviewed by the Planning Commission and
adcepted by the Board of Directors as prescribed by
law. No improvements or construction shall be required,
and these streets and alleys will be maintained at or
above their physical condition upon annexation.
5.) Streets or alleys which were private in every respect
shall remain private after annexation. Owners of
properties abutting such streets or alleys may request
dedication by following the procedures outlined for
submission of preliminary plats. Dedication of right -
of -way for alleys shall provide a tie to the public
street system at both ends.
6.) A Review Committee consisting of the Planning Director
and the City Engineer shall evaluate each incidence
whereby dedication is at issue. A recommendation in
written form shall be made on each qualifying request
and presented to the Commission at a public hearing.
This Committee shall act in the capacity of Technical
Advisor only to the Planning Commission and Subdivision
Committee. Appeals from decisions or actions of this
Committee may be filed with the Planning Commission,
after review by the Subdivision Committee.
7.) The Planning Commission shall determine that a need
exists for a public street.
8.) Citizens desiring to dedicate private streets shall
assume all costs to include platting, engineering, and
construction.
9.) No street shall be offered nor reviewed for dedication
where no structure abuts the right -of -way or where such
action would circumvent the Subdivision Ordinance Review
for new streets and /or subdivision.
10.) In those instances where a private road was created by
land sales constituting a violation of the Subdivision
Ordinance, the property from which the road was derived
shall be included in preliminary plat submissions.
11.) The review criteria shall be as follows:
a. The street proposed will be located within a
dedicated right -of -way of not less than 40 feet.
b. The pavement surface shall be at least 20 feet
wide with adequate shoulders. The pavement must
be of asphaltic concrete or portland concrete
construction. The shoulders shall have a minimum
of a single surface treatment.
c. The pavement thickness must be equivalent to a
minimum of six inches of compacted, crushed stone
(SB -2), base course plus two inches of asphaltic
concrete placed on an adequate subgrade.
d. The Planning Commission may require proof of
pavement base course and subgrade conditions
during the technical review of the street, only
after submission of a plat.
e. Horizontal and vertical curves and other geometric
conditions of the street must be judged safe for
existing and future traffic conditions.
f. Dead -end streets shall provide an adequate turna-
round for sanitation and emergency vehicles both
in dimension and improvements.
g. The street shall brave sufftctent crown to permit
normal drainage from the pavement surface.
h. Street side drainage ditches shall be permitted
except in those cases where the Planning Commission
determines that curb and gutter and /or underground
drainage is the only feasible method to handle the
drainage.
i. All drainage structures within the right -of -way
shall be of sufficient size and type construction
to meet other City ordinances or be judged adequate
by the Planning Commission.
J. Street grades and intersection approach grades shall
meet other City ordinances or be judged satisfactory
for existing and future traffic conditions.
k. Utility alignment and depth shall meet all City
policies or be judged satisfactory by the Planning
Commission. The applicant shall show all existing
or proposed utilities on the dedication application.
1. The Planning Commission may designate drainage,
utility or public use easements as required to
maintain the street.
m. The Planning Commission may require the applicant
to post a one year maintenance bond for any new
construction not to exceed one -half of the con-
struction costs. The bond will become effective
upon final inspection and acceptance of the
construction.
SECTION 4. This Ordinance shall be in full force and effect
from and after its passage.
