ORDINANCE NO. 13,993
AN ORDINANCE ESTABLISHING PLANNING CONTROL
AND REGULATING ENGINEERING, CONSTRUCTION
AND MAINTENANCE ACTIVITIES CONDUCTED WITHIN
THE PUBLIC RIGHTS -OF -WAY: AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. (a) That all plans concerning engineering, construction
or maintenance work within the public rights -of -way, except for emergencies,
shall be subject to review and coordination by the Department of Public
Works. Work done as emergency work shall be reported to the Department of
Public Works no later than the first working day following said work.
(b) In the event a person, firm, corporation or utility plans a major
construction project or an extensive maintenance - replacement project which
is located upon, in, under or above the public rights -of -way of an arterial
or collector street, as defined by the most current Master Street Plan,
they shall submit programming data and preliminary plans for the project
to the Director of Public Works for review prior to beginning any work with-
in the said rights -of -way. Provided, however, that implementation of review
procedures encompassed in the provisions of the ordinance will be arrived
at with each utility consistant with existing franchise agreements and docu-
mented in a memorandum of understanding between each utility and the Director
of Public Works.
SECTION 2. Failure to comply with any provision of this ordinance
shall result in a fine of not less than Two Hundred Fifty and No /100 ($250.00).
SECTION 3. Regulation of activities conducted within the public rights-
of -way is necessary for the preservation of and advancement of the public
peace, health and safety. Therefore, an emergency is declared to exist and
this ordinance shall take effect and be in full force and effect from and
after the date of its approval.
