HomeMy WebLinkAbout135421 RESOLUTION NO. 13,542 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO 4 EXECUTE A RIGHT -OF -WAY DEDICATION DEED ALONG THE 5 NORTH SIDE OF LOT 1, BLOCK 5 IN THE FRANCES M. ROOTS 6 SUBDIVISION IN THE CITY OF LITTLE ROCK, ARKANSAS, TO THE 7 CITY OF LITTLE ROCK FOR THE INSTALLATION AND 8 MAINTENANCE OF PUBLIC UTILITIES AND OTHER PUBLIC 9 PURPOSES; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the City owns certain property at 1300 Jones Street and 2603 West 13'h Street in the 12 Frances M. Roots Subdivision that has been designated for the Neighborhood Stabilization 2 (NSP2) 13 Program, and 14 WHEREAS, it is necessary to provide sewer service and other utilities to the property that is 15 being redeveloped under the NSP2 Program, and 16 WHEREAS, additional right -of -way is required to accommodate the needed utilities and other 17 public purposes for the property designated for the NSP2 Program. 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE 19 CITY OF LITTLE ROCK, ARKANSAS: 20 Section 1. The Mayor and City Clerk are hereby authorized to execute a dedication deed, in 21 a form acceptable to the City Attorney, to grant right -of -way for installation and maintenance of public 22 utilities and for other public purposes for certain property along the north side of Lot 1, Block 5 in the 23 Frances M. Roots Subdivision, Worthen and Brown's Addition to Little Rock, Pulaski County, Arkansas, 24 more particularly described as follows: 25 Beginning at the Northwest corner of Lot 1, Block 5 in the Frances M. Roots 26 Subdivision, Worthen and Brown's Addition to Little Rock, Pulaski County, Arkansas; 27 thence, S 8759' 07" E, along the South right -of -way of 13th Street, a distance of 60.74 28 feet to a point; thence leaving said right -of -way, S 00 °35'38" W, a distance of 2.24 feet to 29 a point; thence, S 89'24'22" W, a distance of 60.93 feet to a point; thence, N 02'16'52" 30 E, a distance of 5.01 feet to the point of beginning, containing 220.14 square -feet, more 31 or less. 32 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, 33 or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or [Page 1 of 21 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
