HomeMy WebLinkAbout20612i �• AG 3 s ORDINANCE NO. 20,612 2012044125 Received: 7/18/2012 2:44:59 PM Recorded: 07/18/2012 03:06:25 PM Filed & Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUIT /COUNTY CLERK Fees $20.00 RDINANCE TO ABANDON APPROXIMATELY 1,100 LINEAR 4 FEET OF THE FIFTY -FIVE (55)- FOOT -WIDE PATRICK COUNTRY 5 ROAD RIGHT -OF -WAY NORTH OF TRACT E, THE RANCH 6 SUBDIVISION, IN THE CITY OF LITTLE ROCK, ARKANSAS; AND 7 FOR OTHER PURPOSES. 8 9 WHEREAS, a request was made to vacate and abandon ],100 linear -feet of the fifty-five (55) -foot 10 wide Patrick Country Road right -of -way North of Tract E, The Ranch Subdivision in the City of Little 11 Rock, Arkansas, said request being made in order to use the area of abandonment as an easement and 12 drainage tract to serve adjacent developments, pursuant to the City's general police power authority under 13 Ark. Code Ann. § 14 -54 -104; and 14 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have 15 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the street right -of- 16 way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise noted 17 below; 18 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 19 OF LITTLE ROCK, ARKANSAS: 20 Section 1. The Board of Directors hereby releases, vacates, and abandons 1,100 linear -feet of the 21 fifty -five (55) -foot wide Patrick Country Road right -of -way North of Tract E, The Ranch Subdivision, 22 said abandoned area to be used as an easement and tract for drainage in adjacent developments, subject to 23 the following conditions: 24 1. The Master Plan must be amended to move the collector street designation from 25 Patrick Country Road to Valley Ranch Drive; 26 2. The entire area of abandonment will be retained as a utility and drainage easement. 27 3. Patrick Country Road must remain open until the Valley Ranch Drive connection is 28 made to the north portion of Patrick Country Road. 29 4. The area of abandonment must not be fenced as to allow maintenance access for 30 utilities and drainage. 31 Section 2. The City specifically reserves the public utility and drainage easements. 32 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate 33 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
