3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO RENEW
4 THE POLICY FOR WORKERS' COMPENSATION STOP -LOSS
5 COVERAGE WITH MIDWEST EMPLOYERS CASUALTY COMPANY
6 FOR ONE (1) -YEAR EFFECTIVE JULY 1, 2012; AND FOR OTHER
7 PURPOSES.

9 WHEREAS, the City has operated a self - funded Workers' Compensation program since 1985 and
10 relies upon Stop -Loss coverage to cap the cost of individual claims; and,
11 WHEREAS, the Arkansas Workers' Compensation Commission requires that self - insured programs
12 purchase this Stop -Loss coverage; and,
13 WHEREAS, Midwest Employers Casualty Company, the incumbent provider for this coverage, has
14 submitted a renewal proposal for one (]) -year effective July 1, 2012, at a cost of One Hundred Eighty
15 Thousand, Five Hundred Eighty-Two Dollars ($180,582); and
16 WHEREAS, the City's contracted broker /consultant has reviewed the available insurance markets
17 and determined that the renewal proposed by Midwest Employers Casualty Company is on par or better
18 than other options in a limited market which is that offers less coverage with stricter underwriting
19 requirements;
20 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK, ARKANSAS:
22 Section 1. The Board of Directors hereby authorizes the City Manager to enter into a renewal contract
23 with Midwest Employers Casualty Company to provide Workers' Compensation Stop -Loss coverage to
24 the City for one (I) -year, effective July 1, 2012.
25 Section 2. Funding for the renewal is provided in the budget line items for Workers' Compensation.
26 Section 3. 'Veverahility. In the event any title, section, paragraph, item, sentence, clause, phrase, or
27 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
28 adjudication shall not affect the remaining portions of the resolution, which shall remain in full force and
29 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
30 resolution.
31 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
32 resolution are hereby repealed to the extent of such inconsistency.
