HomeMy WebLinkAbout135142012034494 Received: 6/7/2012 3:49:02 PM Recorded: 06/07/2012 03:57:24 PM Filed & Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUIT /COUNTY CLERK 1 RESOLUTION NO. 13,�Jfqs $20.00 2 3 A RESOLUTION TO AUTHORIZE THE MAYOR AND CITY CLERK TO 4 EXECUTE A QUITCLAIM DEED TO CERTAIN PROPERTY LOCATED 5 AT 7400 M STREET IN THE CITY OF LITTLE ROCK, ARKANSAS, TO 6 BRIAN MICHAEL CLARY; AND FOR OTHER PURPOSES. 7 8 WHEREAS, in 1995, the City acquired certain right -of -way property along M Street in Little Rock, 9 Arkansas, pursuant to a warranty deed signed on July 27, 1995, and filed and recorded in Pulaski County 10 Circuit Clerk records as document 95 -71884 on December 11, 1995; and, 11 WHEREAS, the metes and bounds legal description in the above - described warranty deed contains a 12 mistaken call that has placed a cloud on the title of a property adjacent to the right -of -way obtained by the 13 City in 1995; and, 14 WHEREAS, the owner of the adjacent property is in the process of selling such property and desires 15 the City to quitclaim any interest the City inadvertently obtained as a result of the mistaken call; and, 16 WHEREAS, the City Board of Directors has determined that the City should correct the error and 17 provide the needed quitclaim deed to enable the property adjacent to the City's right -of -way to be sold; 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 19 OF LITTLE ROCK, ARKANSAS: 20 Section 1. The Mayor and City Clerk are hereby authorized to execute, in a form approved by the 21 City Attorney, a quitclaim deed and other documents as required to convey to Brian Michael Clary certain 22 lands located in the Pulaski County, Arkansas, more particularly described as follows: 23 Part of Lot 26, Block 16, Riffel & Rhoton's Forrest Park Highland Addition to the City of 24 Little Rock, Pulaski County, Arkansas, more particularly described as Beginning at the 25 SW Corner of Lot 26; thence N 00 °44'24E 5.00 feet; thence S 89 °54'43 "E 38.49 feet; 26 thence N 42 °52'43" E 14.78 feet; thence N 00 °11'25" E 134.24 feet; thence S 89 °00'00" 27 E 3.35 feet to the N.E. Corner of Lot 26; thence S 89 °48'35" E 1.65 feet; thence S 28 00 °11'25 "W 150.03 feet to the S.W. Corner of Lot 26; thence N 89 °54'43" W 53.58 feet 29 to the P.O.B. Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
