HomeMy WebLinkAbout205912012034501 Received: 6212012 3:49:09 PM Recorded: 06107/2012 03:57 :31 PN1 Filed & Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUITICOUNTY CLERK Fees $20.00 1 ORDINANCE NO. 20,591 2 3 AN ORDINANCE TO ABANDON A PUBLIC RIGHT -OF -WAY FOR 4 RAY WINDER DRIVE, LOCATED IN WAR MEMORIAL PARK, 5 LITTLE ROCK, ARKANSAS; AND FOR OTHER PURPOSES. 6 WHEREAS, Ray Winder Drive in War Memorial Park, Little Rock, Arkansas, is a dedicated public 7 street that has not been utilized for street purposes for several years but has been used for parking for the 8 Little Rock Zoo and special events, and 9 WHEREAS, a request has been made to vacate and abandon Ray Winder Drive as a public right -of- 10 way, but to retain existing utility and drainage easements, pursuant to the City's general police power 11 authority under Ark. Code Ann. § 14 -54 -104 (West 2004); and 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 WHEREAS, the Board of Directors has determined that the sole owner on either side of Ray Winder Drive is the City of Little Rock and that abandoning and vacating of this public right -of -way will not have an adverse impact on nearby property owners nor the local traffic, and therefore, the street right -of -way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise noted below; and WHEREAS, the abandonment of Ray Winder Drive will cause no public inconvenience but will allow for a new, environmentally sensitive parking surface to be installed in the area to better provide for the public welfare, safety, comfort and convenience of the inhabitants of the city. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby releases, vacates, and abandons Ray Winder Drive in War Memorial Park, City of Little Rock, Pulaski County, Arkansas, as a public right -of -way, but retains the existing drainage and utility easement rights, said right -of -way being described as: A forty (40) -foot wide strip of property running west 281.06 feet from South Monroe Street within War Memorial Park, in the City of Little Rock, Pulaski County, Arkansas. Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate records of the recorder of the Circuit Clerk in ex- officio recorder of Pulaski County, Arkansas. Section 3. Severability. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
