5 PERMIT RAIN BARRELS FOR THE PURPOSE OF COLLECTING
6 AND STORING RAINWATER; AND FOR OTHER PURPOSES.

8 WHEREAS, the City of Little Rock is committed to the promotion of ideas that will contribute to the
9 sustainability of the environment; and,
10 WHEREAS, research has shown that the use of rain barrels to collect fresh rainwater benefits the
11 environment in numerous ways such as reducing water usage and runoff and providing a fresh source of
12 water to use in gardens and lawns; and,
13 WHEREAS, the City Board of Directors wishes to encourage the use of rain barrels as long as they
14 are installed under certain conditions; and,
15 WHEREAS, LRC §20- 2(a)(2) prohibits any person from allowing stagnant pools of water or vessels
16 in which water might accumulate; and,
17 WHEREAS, in order to allow citizens the opportunity to use rain barrels it is necessary to amend
18 LRC § 20- 3(a)(2) to provide for a new subsection (a)(2)(d).
19 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
20 OF LITTLE ROCK, ARKANSAS:
21 Section 1. Little Rock, Ark., Rev. Code ( "LRC ") § 20- 3(a)(2) (1988) is hereby amended to add a
22 new subsection (d) to permit the use of rain barrels to collect and store rainwater, as follows:
23 (d) Rain Barrels are allowed in the City of Little Rock for the purpose of collecting
24 and storing rainwater from roofs and other non - permeable surfaces that would
25 otherwise be lost to runoff and diverted to storm drains and streams. Equipment for
26 rain barrels shall be screened from view of adjacent properties and the public right -
27 of -way through fencing, landscaping or a combination of the two. Rain barrels must
28 be covered by a lid; if no lid is used, then rain barrels must be covered with a screen
29 that allows water to get in, but prevents the breeding of mosquitoes. The lid or
30 screen, whichever is used, must be securely attached with some form of lock in order
31 to prevent the barrel from being opened and accessed by anyone not authorized by
32 the owner of the barrel. If the barrel has an overflow on the side, it must have
33 screening as well.

Section 2. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph,
item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or
unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this
ordinance, as if such invalid or unconstitutional provision was not originally a part of this ordinance.
Section 3. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this
ordinance are hereby repealed to the extent of such inconsistency.
