WHEREAS, the Sienna Lake Property Owners Association, through their agent, has requested a franchise for the installation of self - opening and closing gates across Sienna Lake Drive at the entrance to the Sienna Lake Subdivision to slow traffic through the area, and WHEREAS, the installation of the requested gates will thereby create a safer neighborhood and will not adversely affect the public interest. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. A franchise for the installation of self - opening and self - closing gates across Sienna Lake Drive approximately 150 feet north from Crystal Valley Road in the Sienna Lake Subdivision, as shown on the attached map, is hereby granted to the Sienna Lake Property Owners Association with the conditions as stated herein. 19 Section 2. No access is to be denied to the traveling public. The gates, which are to be provided and 20 installed by the Sienna Lake Property Owners Association at no expense to the City, are to open 21 automatically as vehicles approach and close when the vehicles clear. In the event of power failure, the 22 gates are to automatically open and stay open. 23 Section 3. No surveillance cameras will be placed within the public right -of -way. 24 Section 4. To prevent excessive delay to the traveling public, the gates are to remain open during 25 peak morning and afternoon traffic periods. The times the gates are to remain open are subject to review 26 and approval by the City Manager. 27 Section 5. The Sienna Lake Property Owners Association will obtain all necessary permits and plan 28 approvals prior to construction. 29 Section 6. The franchise will remain in effect unless modified or revoked by the City Board of 30 Directors. The franchise is granted for a period of ten (10) years following the effective date of this 31 ordinance, and maybe extended by the City Manager for additional five (5) year terms thereafter. 32 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 33 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 1Page 1 of 41 adjudication shall not affect the remaining portions of the ordinance, which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 8. Repealer. All ordinances or resolutions of the City in conflict herewith are hereby repealed to the extent of such conflict. PASSED: May 1, 2012 APPROVED AS TO LEGAL FORM: Thomas M.
