HomeMy WebLinkAbout13493I 2 RESOLUTION NO. 13,493 2012026906 Received: 5/4/2012 11:44:45 AM Recorded: 05/04/2012 11:55:24 AM Filed & Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUIT /COUNTY CLERK Fees $20.00 3 A RESOLUTION TO AUTHORIZE THE PURCHASE OF THREE (3) 4 PROPERTIES OFFERED FOR SALE TO THE CITY OF LITTLE ROCK, 5 TO BE USED FOR NEIGHBORHOOD REVITALIZATION PROGRAMS; 6 AND FOR OTHER PURPOSES. 7 8 WHEREAS, the Board of Directors has stated as one of its goals a desire to provide for 9 neighborhood revitalization, and has taken special efforts to accomplish this goal through its use of 10 various City and Federal funds, and in affirmative actions such as the creation of a Land Bank 11 Commission; and, 12 WHEREAS, in order to accomplish this goal it is required that properties be obtained by the City in 13 areas that are appropriate for revitalization; and, 14 WHEREAS, the Land Bank Commission has chosen a focus area which encompasses the area of 15 Interstate 630 as the northern boundary, Pine Street as the western boundary, 17`h Street as the southern 16 boundary, and Martin Luther King Drive as the eastern boundary. 17 WHEREAS, the Land Bank Commission has identified three (3) properties within its Focus Area, 18 located at 3108 West 17`h Street, 1521 South Maple Street, and 1513 Valmar Street, Little Rock, 19 Arkansas, which can be used to fulfill the City's stated goals; and, 20 WHEREAS, City Staff has obtained a full title search on each property which revealed valid title and 21 confirmed Quiet Title Decrees for each property; and, 22 WHEREAS, City Staff has performed an environmental assessment of each property pursuant to 24 23 C.F.R. § 58, et seq. (2003), which revealed no environmental problems; and, 24 WHEREAS, Little Rock Homes, LLC, has negotiated with the City a total purchase price of 25 $9,000.00; and, 26 WHEREAS, Little Rock Homes, LLC, will be responsible for all real estate taxes levied through the 27 date of closing; and, 28 WHEREAS, there are four (4) outstanding City liens in the amount of One Thousand, Two Dollars 29 and 30/100 ($1,002.30) against the properties, which will be released on the date of closing; and, 30 WHEREAS, funds to pay the purchase price for the properties are available in the Land Bank's 31 Community Development Block Grant (CDBG) Account No. 230009- G62409; and, 32 WHEREAS, pursuant to State law the City must obtain authority to purchase prdperty,'.� C) 33 resolution adopted by the Board of Directors; lijQ ;' ",.c ,. 'O •:r /,i �j'+f,.$L�l ICY J ,G (Page l of 21 -1 •J.� Q=:= 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Pursuant to Ark. Code Ann. § 14- 54- 302(c) (West Supp. 2012), the City must obtain authority from the Board of Directors to purchase the properties located at 3108 West 17`h Street, 1521 South Maple Street, and 1513 Valmar Street, Little Rock, Arkansas, as identified in this resolution. Section 2. The Board of Directors, pursuant to Ark. Code Ann. § 14- 54- 302(c) (West Supp. 2012), must authorize the Mayor and City Clerk to execute any documents necessary to complete the purchase of the properties identified in this resolution. Section 3. If acquired, this property shall be used for a public purpose, specifically for City neighborhood revitalization programs. Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect a if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsi tency.
