3 AN ORDINANCE TO ABANDON THE DRAINAGE AND UTILITY
4 EASEMENTS REMAINING IN THE FORMERLY- ABANDONED STATE
5 STREET RIGHT -OF -WAY, LOCATED BETWEEN BLOCKS 222 AND
6 232, ORIGINAL CITY OF LITTLE ROCK, ARKANSAS; AND FOR
7 OTHER PURPOSES.

9 WHEREAS, a request was made to abandon the utility and drainage easements retained in the
10 formerly- abandoned State Street right -of -way, located between Blocks 222 and 232, Original City of
11 Little Rock, Arkansas, pursuant to the City's general police power authority under Ark. Code Ann. § 14-
12 54 -104; and
13 WHEREAS, the Board has determined that the abandoning of these utility and drainage easements
14 will not have an adverse impact on the public welfare and safety, and therefore, the utility and drainage
15 easements abandoned by this ordinance are no longer needed for corporate purposes;
16 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
17 OF LITTLE ROCK, ARKANSAS:
18 Section 1. The Board of Directors hereby releases, vacates, and abandons the utility and drainage
19 easements retained in the formerly- abandoned State Street right -of -way, located between Blocks 222 and
20 232, Original City of Little Rock, Arkansas.
21 Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
22 records of the recorder of the Circuit Clerk in ex- officio recorder of Pulaski County, Arkansas.
23 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
24 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
25 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
26 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
27 of the ordinance.
28 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
29 inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
