8 THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
9 PURPOSES.

NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. That the zoning classification of the following described property be changed from POD
and R -2, Single- Family, to PD -O:
Lots 9 and 10, Block 10 CO Brack Addition, Little Rock, Arkansas. Less and except part
of Lots 9 and 10, Block 10, of the CO Brack Addition to the City of Little Rock, Pulaski
County, Arkansas, being more particularly described as follows: Beginning at the SW
corner of Lot 9, said corner also being situated on the east right -of -way line of Fair Park
Boulevard; thence NO 1 °23'42 "E along the existing east right -of -way line 99.83 feet to the
NW Corner of said Lot 10; thence S86 °26'39 "E along the north line of said lot 10, 11.10
feet to a point on the proposed east right -of -way line of Fair Park Boulevard; thence
S00 °41' 12 "E along the proposed east right -of -way line 100.03 feet to a point on the south
line of said Lot 9; thence N86 °26'39 "W along the south line of Lot 9, 14.74 feet ti'i 4

platted) fifty (50) feet; thence south 83 °E 30.2 feet; thence S77 0E 114.1 feet to the west
line of an alley; thence N80 feet to the northeast corner of Lot 8; thence west 140 feet to
the point of beginning. Less and except: beginning at the northwest corner of said Lot 8,

point on the east right -of -way line of Fair Park Boulevard (as acquired in 1998); thence
S00 °41' 12 "E along the east right -of -way line (as acquired in 1998) 53.32 feet; thence
N74 035'27 "W, 17.18 feet to a point on the east right -of -way line of Fair Park Boulevard
(as originally platted); thence NO 1029'42"E along the east right -of -way line (as originally
platted) 49.68 feet to the point of beginning and containing 806 square -feet or 0.02 acres,
more or less.
Section 2. That the approval of 3013 Fair Park Boulevard Revised Short-Form PD -O (Z- 8631 -A),
located at 3013 Fair Park Boulevard, is subject to compliance with the following additional conditions:
That the preliminary site development plan/plat be approved as submitted, including all
staff comments and conditions as outlined in the Planning Commission Agenda Staff
Report in paragraphs D, E, F and including any conditions indicated in the staff analysis
in paragraph H and subject to additional conditions imposed at the Planning Commission
Public Hearing as amended by the applicant.
Section 3. That the preliminary site development plan/plat be approved as recommended by the
Little Rock Planning Commission.
Section 4. That the change in zoning classification contemplated for 3013 Fair Park Boulevard
Revised Short-Form PD -O (Z- 8631 -A), located at 3013 Fair Park Boulevard, is conditioned upon
obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of
the Code of Ordinances.
Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little
Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects
necessary to affect and designate the change provided for in Section 1 hereof.
Section 6. That this ordinance shall not take effect and be in full force until the final approval of the
plan.
Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.

Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with
the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
