PULASKI COUNTY CIRCUIT /COUNTY CLERK Fees $20.00 RESOLUTION NO. 13,472 A RESOLUTION TO ACCEPT TITLE TO PROPERTIES DONATED TO THE CITY OF LITTLE ROCK BY SPECIAL WARRANTY DEED, TO BE USED FOR NEIGHBORHOOD REVITALIZATION PROGRAMS; AND FOR OTHER PURPOSES. 1.000, A7 WHEREAS, the Board of Directors has stated as one of its goals a desire to C. neighborhood revitalization, and has taken special efforts to accomplish this goal thro. various City and Federal funds, and in affirmative actions, such as the creation of 11 Commission; and, 12 WHEREAS, in order to accomplish this goal it is required that properties be obtained by the City in 13 areas that are appropriate for revitalization; and, 14 WHEREAS, MKH Family, LLC, a duly organized limited liability company in good standing under 15 Arkansas law, by and through its authorized members, has indicated its desire to donate to the City of 16 Little Rock, Arkansas, the properties located at 4208 West 10 Street, Little Rock, Arkansas, 72204 and 17 4624 West 23`d Street, Little Rock, Arkansas 72209; and, 18 WHEREAS, the City wishes to accept the properties for use in its neighborhood revitalization 19 efforts; and, 20 WHEREAS, the City has obtained a full title search which revealed valid title to the properties and 21 no significant title issues; and, 22 WHEREAS, the City has performed an environmental assessment of the properties pursuant to 24 23 C.F.R. § 58, et seq. (2003), which revealed no environmental problems; and, 24 WHEREAS, the parcels are both 7,000 square -foot lots with no structures; and, 25 WHEREAS, in consideration for the donation of the properties for the public purpose of 26 neighborhood revitalization, the City has agreed to pay the 2011 Real Estate Taxes owed to the Pulaski 27 County Treasurer in the total amount of One Hundred Twenty-Nine and 72/100 Dollars ($129.72); and, 28 WHEREAS, funds to pay the real estate taxes are available in Land Bank Account S35A004; and, 29 WHEREAS, State law requires that the City accept the property by resolution adopted by the Board 30 of Directors; 31 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 32 OF LITTLE ROCK, ARKANSAS: (Pagel of 2l 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 Section 1. The Board of Directors hereby adopts this Resolution to accept title to the properties located at 4208 West 14'h Street, Little Rock, Arkansas, 72204 and 4624 West 23`d Street, Little Rock, Arkansas 72209, which have been offered as a donation to the City of Little Rock. Section 2. The property shall be used for a public purpose, specifically for City revitalization programs. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect a if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsi tency.
