HomeMy WebLinkAbout134561 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 FAO) 23 24 25 26 27 28 29 30 31 32 33 RESOLUTION NO. 13,456 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO EXECUTE A PUBLIC AGENCY SERVICES AGREEMENT TO PROVIDE FLEET MAINTENANCE AND REPAIR SERVICES FOR LITTLE ROCK CONVENTION AND VISITORS BUREAU VEHICLES AND EQUIPMENT; AND FOR OTHER PURPOSES. WHEREAS, Arkansas Code Ann. § 25- 20- 108(a) (West Supp. 2011) authorizes one (1) or more public agencies to contract with any one (1) or more other public agencies to perform any governmental service, activity or undertaking which each of the public agencies entering into the contract is authorized by law to perform alone; and WHEREAS, the City of Little Rock owns and operates several fleet maintenance and repair service facilities ( "Fleet Service Centers ") for the purpose of routine maintenance and repair of City -owned vehicles and mechanical equipment; and WHEREAS, the Little Rock Convention and Visitors Bureau ( "LRCVB ") owns vehicles and equipment but does not operate a fleet services facility; and WHEREAS, the LRCVB and its governing body the Little Rock Advertising and Promotion Commission ( "APC ") are interested in establishing a contractual relationship with the City for the performance of such services at the City's Fleet Service Centers; and WHEREAS, the additional fleet services responsibilities will not have significant impact on the City's Fleet Service Center operations and the additional cost to the City for labor and parts will be reimbursed by the LRCVB. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. Pursuant to the authority set forth in Arkansas Code Ann. § 25 -20 -108 (West Supp. 2011), the City Manager is authorized to execute a public agency service agreement, in a form to be approved by the City Attorney, to provide maintenance and repair services for Little Rock Convention and Visitors Bureau vehicles and equipment for a one (1) -year term with option to renew the agreement for two (2) additional one (1) -year terms by mutual agreement of the parties. Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and PAGE 1 OF 21 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
