3 AN ORDINANCE TO ABANDON TWO (2) UTILITY AND DRAINAGE
EASEMENTS, LOCATED WITHIN LOT H -3A, RIVERDALE ADDITION,
5 IN THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, a request was made to vacate and abandon two (2) utility and drainage easements
9 located within Lot H -3A, Riverdale Addition, pursuant to the City's general police power authority under
10 Ark. Code Ann. § 14 -54 -104; and
11 WHEREAS, the Board has determined that the easement is located entirely within the applicant's
12 property and applicants also own the abutting tracts; and
13 WHEREAS, none of the utility companies object to the abandonment of the easements and no
14 facilities are currently located in the easement;
15 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
16 OF LITTLE ROCK, ARKANSAS:
17 Section 1. The Board of Directors hereby releases, vacates, and abandons the two (2) utility and
18 drainage easements described as follows:
19 Easement Area Description #1
20 Part of Tract H -3A, Riverdale Addition to the City of Little Rock, Pulaski County,
21 Arkansas, as filed for record in Plat Book 34, Page 99, being more particularly described
22 as follows:
23 BEGINNING at the NW corner of said Tract H -3A; thence N 70 112'34" E along the
24 north line of said Tract H -3A, a distance of 370.01 feet to the east line of said Tract H-
25 3A; thence S 19 °31'34" E along the east line of said Tract H -3A, a distance of 10.00 feet;
26 thence S 70'12'34" W, a distance of 367.94 feet; thence along a curve to the right having
27 a Radius of 25.00 feet, an Arc Length of 10.27 feet and a Chord bearing and distance of
28 N 31 °11'43" W, 10.20 feet to the POINT OF BEGINNING, containing 0.08 Acres (3,693
29 square- feet.), more or less.

31 Part of Tract H -3A, Riverdale Addition to the City of Little Rock, Pulaski County,
32 Arkansas as filed for record in Plat Book 34, Page 99, being more particularly described

west line of said Tract H -3A, a distance of 227.34 feet; thence along a curve to the left
having a Radius of 60.00 feet, an Arc Length of 5.01 feet and a Chord bearing and
distance of N 68 °05'42" E, 5.00 feet; thence S 19 °33'15" E, a distance of 197.55 feet;
thence N 70 °30'14" E, a distance of 5.00 feet; thence S 19 °33'15" E, a distance of 29.99
feet to the south line of said Tract H -3A; thence S 70 °28'30" W along the south line of
said Tract H -3A, a distance of 10.00 feet to the POINT OF BEGINNING, containing
0.03 Acres (1,287 square- feet), more or less.
Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
of the ordinance.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
