HomeMy WebLinkAbout20547* � s O' fy r cl 2012010787 Received: 2/24!2012 3:32:14 PM Recorded: 02,2412012 03:39:44 PM Filed & Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUIT /COUNTY CLERK Fees $20.00 ORDINANCE NO. 20,547 ORDINANCE TO ABANDON A PORTION OF A FIFTEEN (15)- FOOT WIDE ALLEY LOCATED IN BLOCK 63, PULASKI HEIGHTS 5 ADDITION TO THE CITY OF LITTLE ROCK, ARKANSAS; AND 6 FOR OTHER PURPOSES. 7 WHEREAS, a request was made to vacate and abandon 103.5 feet of a fifteen (15) -foot wide alley 8 located in Block 63, Pulaski Heights Addition to the City of Little Rock, Arkansas, pursuant to the City's 9 general police power authority under Ark. Code Ann. § 14 -54 -104; and 10 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have 11 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the street right -of- 12 way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise noted 13 below; 14 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 15 OF LITTLE ROCK, ARKANSAS: 16 Section 1. The Board of Directors hereby releases, vacates, and abandons 103.5 feet of a fifteen 17 (15) -foot wide alley located in Block 63, Pulaski Heights Addition to the City of Little Rock, Arkansas, 18 being that portion lying between Lot 9 west of the alley and Lots 2 and 3 lying east of the alley, Block 63, 19 Pulaski Heights Addition. 20 Section 2. The City specifically reserves the public utility and drainage easements. 21 Section 3. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate 22 records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas. 23 Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 24 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 25 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 26 effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part 27 of the ordinance. 28 Section 5. Repealer.
