4 EASEMENT RIGHTS FOR BROOKWOOD DRIVE, LOCATED IN
5 THE RIVERDALE ADDITION TO THE CITY OF LITTLE ROCK,
6 ARKANSAS; AND FOR OTHER PURPOSES.
7 WHEREAS, a request was made to vacate and abandon Brookwood Drive as a public right -of -way,
8 including the abandonment of utility and drainage easements, located in the Riverdale Addition to the
9 City of Little Rock, Arkansas, pursuant to the City's general police power authority under Ark. Code
10 Ann. § 14 -54 -104; and
11 WHEREAS, the Board has determined that the abandoning of this public right -of -way will not have
12 an adverse impact on the adjacent property owners nor the local traffic, and therefore, the street right -of-
13 way abandoned by this ordinance is no longer needed for corporate purposes, except as otherwise noted
14 below; and
15 WHEREAS, all utility companies and the Public Works Department have approved the request to
16 abandon the easement rights;
17 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
18 OF LITTLE ROCK, ARKANSAS:
19 Section 1. The Board of Directors hereby releases, vacates, and abandons Brookwood Drive as a
20 public right -of -way, together with easement rights, said right -of -way being described as:
21 Part of the SE'A NE' /4, Section 32, T -2, N, R -12 -W, City of Little Rock, Pulaski County,
22 Arkansas, begin more particularly described as follows: Beginning at the NW corner of
23 Tract H -3 -A, Riverdale Addition to the City of Little Rock, Pulaski County, Arkansas, as
24 file for record in plat book 34, page 99; thence N19 °31' 19 "W, a distance of 205.87 feet;
25 thence along a curve to the right having a Radius of fifty (50) feet, an Arc Length of
26 63.39 feet and a Chord bearing and distance of N 16 °23' 18 "E. 59.23 feet to the south right
27 of way line of Cedar Hill Road; thence S53 012'24 "W, a distance of 164.71 feet; thence
28 along a curve to the right having a Radius of fifty (50) feet, an Arc Length of 90.44 feet
29 and a Chord bearing and distance of S71 °41'56 "E, 78.60 feet; thence S19 031'20 "E, a
30 distance of 156.68 feet; thence along a curve to the right having a Radius of twenty -five
31 (25) feet, an Arc Length of 21.75 feet and a Chord bearing and distance of S05 °33'37 "W,
32 21.07 feet; thence along a curve to the left having a Radius of sixty (60) feet, an Arc
33 Length of 146.21 feet and a Chord bearing and distance of S39 °42'24 "E, 112.63 feet;

Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate
records of the recorder of the Circuit Clerk in ex officio recorder of Pulaski County, Arkansas.
Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part
of the ordinance.
Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are
inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
