HomeMy WebLinkAbout205422012007874 Received: 2/9/2012 2:49:22 PM Recorded: 02/09/2012 03:05:04 PM Filed & Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUIT /COUNTY CLERK 1 ORDINANCE Tfff.t , -42 2 3 AN ORDINANCE TO AMEND LITTLE ROCK, ARK., ORDINANCE NO. 4 20,527 (JANUARY 3, 2012) TO DISPENSE WITH COMPETITIVE 5 BIDDING AND TO AUTHORIZE THE CITY MANAGER TO ENTER 6 INTO A SOLE SOURCE MASTER SERVICE AGREEMENT WITH 7 LAWSON SOFTWARE AMERICAS, INC., FOR THE PURCHASE OF 8 LICENSES AND MAINTENANCE OF THE LAWSON BUDGETING AND 9 PLANNING SOFTWARE MODULE; AND FOR OTHER PURPOSES. 10 11 WHEREAS, the City's accounting and human resources software was purchased in 2006 from 12 Lawson Software Americas, Inc., ( "Lawson "), and 13 WHEREAS, the Lawson Budgeting and Planning module did not meet the City's needs at that time, 14 and 15 WHEREAS, Lawson has since updated their Budgeting and Planning module to include the step and 16 grade functionality that the City requires in a budgeting software, and 17 WHEREAS, the Lawson Budgeting and Planning module will be integrated with the other Lawson 18 modules that the City currently owns and will be able to extract the needed information to complete the 19 budget process effectively and efficiently, and 20 WHEREAS, on January 3, 2012, the City Board of Directors adopted Little Rock, Ark., Ordinance 21 No. 20,527 (January 3, 2012) to authorize the City Manger to dispense with competitive bidding and enter 22 into a sole source five (5) -year master service agreement with Lawson, in the amounts of $33,900.00 for 23 licenses and an amount not to exceed $8,300.00 for maintenance, for the purchase of licenses and 24 maintenance of the Lawson Budgeting and Planning software module, and 25 WHEREAS, the $8,300.00 amount for the maintenance cost for this software module was based on 26 one (1) -year of maintenance rather than the five (5) -year agreement total, and 27 WHEREAS, the five (5) -year total for the maintenance for this software module should not exceed 28 29 30 $40,440.00, and WHEREAS, it is now necessary to amend Ordinance No. 20,527 to reflect the correct amount for the maintenance for the Lawson Budgeting and Planning software module for �• W DIRECT()'R' . .R, . k 31 agreement. 32 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD 33 OF LITTLE ROCK, ARKANSAS: [PAGE 1 OF 2] term of the CITY I Section 1. Because the Lawson Budgeting and Planning module will be integrated with the other 2 Lawson modules that the City currently owns and will be able to extract the needed information to 3 complete the City's budget process effectively and efficiently, it is not feasible and impractical to 4 competitively bid in this instance. 5 Section 2. Section 2 of Little Rock, Ark., Ordinance No. 20,527 (January 3, 2012) is hereby 6 amended to state the following: 7 The City Manager is authorized to dispense with competitive bidding and enter into a 8 sole source five (5) -year master service agreement with Lawson, in the amounts of 9 $33,900.00 for licenses and an amount not to exceed $40,440.00 for maintenance, for the 10 purchase of licenses and maintenance of the Lawson Budgeting and Planning software 11 module. 12 Section 3. Funds for the Lawson Budget and Planning module licenses of $33,900.00 and 13 maintenance of $40,440.00 have been appropriated and are available in the Information Technology 14 Department's Software Recurring Maintenance Account No. 103001- 61350. 15 Section 4. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 16 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 17 unconstitutional, such declaration or adjudication shall not affect the remaining portions of this ordinance 18 which shall remain in full force and effect as if the portion so declared or adjudged invalid or 19 unconstitutional were not originally a part of this ordinance. 20 Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, particularly Little Rock, 21 Ark., Ordinance No. 20,527 (January 3, 2012), that are inconsistent with the provisions of this ordinance, 22 are hereby repealed to the extent of such inconsistency. 23 24 25 26 27 28 29 30 31 32 33 34 35 36 ADOPTED: February 7, 2012 AS TO LEGAL FORM: t".
