ORDINANCE WM9'S��
AN ORDINANCE TO AMEND CHAPTER 28 OF THE CODE OF
ORDINANCES TO PROVIDE FLEXIBILITY IN THE NEGOTIATION OF
VOLUME DISCOUNT AMOUNTS FOR DETERMINATION OF SOLID
WASTE DISPOSAL FEES; AND FOR OTHER PURPOSES.
WHEREAS, the City desires to provide additional flexibility to the City Manager to negotiate
volume discount agreements with City landfill customers, and
WHEREAS, removing the current strict criteria for a volume discount will enable the City to bring in
needed revenues through volume discount agreements with high - volume landfill customers when the
amount of the solid waste volume is large, but less than the current requirement of 2,500 tons per month.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
Section 1. Subsection 28 -25(b) of Chapter 28 of the City of Little Rock Code of Ordinances is hereby
deleted and replaced with the following language:
(b) The City Manager is hereby authorized to negotiate volume discount
agreements with City landfill customers. All volume discount agreements and amounts shall
be approved in advance by the Board of Directors.
Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
adjudication shall not affect the remaining portions of the ordinance, which shall remain in full force and
effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
ordinance.
Section 3. Repealer. All ordinances or resolutions of the City in conflict herewith are hereby
repealed to the extent of such conflict.
