CODE TO DECLARE PARKING ANY 5 VEHICLE IN RESIDENTIAL YARDS, OR ALLOWING ANY 6 PERSON TO PARK ANY VEHICLE IN A RESIDENTIAL YARD, IN 7 VIOLATION OF ZONING ORDINANCES AS A NUISANCE 8 SUBECT TO IMMEDIATE CITATION; TO AMEND THE PENAL - 9 TY PROVISION OF LITTLE ROCK, ARK., REV. CODE § 20 -1 AS 10 TO PENALTIES; TO REMOVE A SEVEN (7) -DAY NOTICE 11 REQUIREMENT FOR THE ISSUANCE OF A CITATION; AND 12 FOR OTHER PURPOSES. 13 14 WHEREAS, the City zoning code currently permits a person up to seven (7) days to accomplish 15 compliance with a zoning violation before the issuance of a citation; and, 16 WHEREAS, illegally parking vehicles in residential yards in violation of Little Rock, Ark., Rev. 17 Code § 36 -513 (1988) should be stopped immediately because of the deleterious impact it has on a neigh - 18 borhood, and on the property values within the neighborhood; and, 19 WHEREAS, it is a nuisance to violate the provision as to parking vehicles in a residential yard which 20 should be addressed immediately, and not after a seven (7)- day notice period; and, 21 WHEREAS, it is appropriate to have a separate penalty for the nuisance of parking a vehicle in a res- 22 idential yard; 23 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY 24 OF LITTLE ROCK, ARKANSAS: 25 Section 1. Little Rock, Ark., Rev. Code § 20 -1 (1988) is hereby amended to read as follows: 26 Unless otherwise set out in a specific section, any person convicted of a viola - 27 tion of any of the provisions of this article shall be punished as provided in section 28 1 -9 except as set forth below. 29 Section 2. Chapter 20 of Article I Little Rock, Ark., Rev. Code (1988) is amended to add ! fp,)J.ow- 30 ing section:° -�x° 4 31 (a) (1) Parking a vehicle in a residential yard in violation of section 3 513 32 a nuisance subject to an immediate citation; , .,..� Al, [PAGE 1 OF 21 1 (2) Any vehicle illegally parked in a residential yard may be cited for the 2 violation of this ordinance, and the owner shall be responsible for any 3 penalties imposed. 4 (b) (1) Allowing any person to park a vehicle in a residential yard in viola- s tion of section 36 -513 is a nuisance subject to an immediate citation; 6 (2) Any owner or occupant of a residence who permits any person to park 7 illegally any vehicle in a residential yard may be cited for the violation of 8 this ordinance, and the owner or occupant shall be responsible for any 9 penalties imposed. 10 (c) Any person who pleads guilty or nolo contendere, or who is found guilty 11 at trial of parking a vehicle in a residential yard, or allowing any vehicle 12 to be parked in a residential yard, shall be fined Fifty Dollars ($50.00) and 13 any applicable court costs. 14 Section 3. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 15 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconsti- 16 tutional, such declaration or adjudication shall not affect the remaining provisions of this ordinance, as if 17 such invalid or unconstitutional provision was not originally a part of this ordinance. 18 Section 4. Repealer.
