That the zoning classification of the following described property be changed from R -2, 13 Single- Family, to PCD: 14 That part of the E '/2 of the SE '/4 of Section 32, T -1 -N R -12 -W, Pulaski County, 15 Arkansas, more particularly described as follows: Beginning at a point 165 feet west of 16 the SE corner of said E '/2 of the SE '/4 of the SW '/4, thence continuing west 82.5 feet; 17 thence north 330 feet; thence east 82.5 feet; thence south 330 feet to the point of 18 beginning, less and except that part deeded to the Arkansas State Highway Commission 19 in Warranty Deed recorded as Instrument No. 89- 06289, filed February 2, 1989, records 20 of Pulaski County, Arkansas. 21 Section 2. That the approval of Dowler Properties, Inc., Short-Form PCD (Z- 8531 -A), located at 22 3618 Baseline Road, is subject to compliance with the following additional conditions: 23 That the preliminary site development plan/plat be approved as submitted, including all 24 staff comments and conditions as outlined in the Planning Commission Agenda Staff 25 Report in paragraphs D, E, F and including any conditions indicated in the staff analysis 26 in paragraph H and subject to additional conditions imposed at the Planning Commission 27 Public Hearing as amended by the applicant. 28 Section 3. That the preliminary site development plan /plat be approved as recommended by the 29 Little Rock Planning Commission. 30 Section 4. That the change in zoning classification contemplated for Dower es, Inc., Short- y 31 Form PCD (Z- 8531 -A), located at 3618 Baseline Road, is conditioned:_ upon ,obtainidg,>aVinal plan 32 approval within the time specified by Chapter 36, Article VII, Sectloit 36 -454- (e) of the tode of 33 Ordinances. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little 2 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects 3 necessary to affect and designate the change provided for in Section 1 hereof. 4 Section 6. That this ordinance shall not take effect and be in full force until the final approval of the 5 plan. 6 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 7 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 8 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 9 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 10 ordinance. 11 Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
