3 AN ORDINANCE TO ACCEPT THE FOURCHE CREEK WASTEWATER
4 TREATMENT FACILITY ANNEXATION; TO ADD CERTAIN LANDS
5 TO THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, a petition for voluntary annexation (the "Petition ") was filed with the County Clerk of
9 Pulaski County, Arkansas, by the owner of hereinafter designated lands praying that said lands be
10 annexed to and made part of the City of Little Rock, Arkansas; and,
11 WHEREAS, on November 29, 2011, the County Court of Pulaski County, Arkansas, found that the
12 Petition was signed by a majority of the total number of the real property owners of the area to be
13 annexed and by the owners of some 212.5 acres of said area; and,
14 WHEREAS, said lands are contiguous to and adjoining the present corporate limits of the City of
15 Little Rock; and,
16 WHEREAS, an accurate map of said lands has been filed with and made a part of said Petition; and,
17 WHEREAS, proper notice has been given for the time and in the manner prescribed by law; and,
18 WHEREAS, all things pertaining thereto have been done in the manner prescribed by law and that
19 said lands should be annexed to and made part of the City of Little Rock.
20 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
21 OF LITTLE ROCK, ARKANSAS:
22 Section 1. The following described territory contiguous and adjoining the City of Little Rock,
23 Arkansas is accepted as annexed to and made a part of the City of Little Rock, Pulaski County, Arkansas,
24 to wit:

28 Tract 1
29 All of the S' /2 of the NW'/4, and the N%2 of the SW' /4 of Section 23, and a part of the S' /2 of the
30 NE' /4, and the N' /2 of the SE' /4, of Section 22, T -1 -N, R -1 1 -W, of the 5th Principal Meridian,
31 Pulaski County, Arkansas (9500 Birdwood Drive), being more particularly described as

20 distance of 1,328.29 feet to a set '/2" rebar and cap for the NW Corner of the N/2 of the SE'

31 as set out in Civil Case #LR-67-C- 13 1, and judgment in United States District Court
32 recorded in Book 25, Page 54.
33 3. Warranty Easement Deed Number 201071381, recorded in the records of Pulaski
34 County, Arkansas.

3 Together with all adjacent and abutting streets and rights -of -way.
4 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
5 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or
6 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and
7 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
8 ordinance.
9 Section 3. Repealer. All ordinances or resolutions of the City in conflict herewith are hereby
10 repealed to the extent of such conflict.
