NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That Chapter 30 of the Code of Ordinances is amended to provide for a deferral of certain requirements within the Master Street Plan for adjacent property along East 30`h Street being developed by Union Rescue Mission Short -Form PD -O at 2129 Confederate Boulevard as follows: Subsection a. Chapter 30 Article VI requiring developers to construct roadway improvements to the requirements of the Master Street Plan will be deferred for a period of five (5) years or until adjacent development along East 30`h Street occurs whichever occurs first. The specific deferral is for improving East 30`h Street as part of Union Rescue Mission Short-form PD -O along the frontage of the property at 2129 Confederate Boulevard to commercial street standard including widening, curb, gutter, sidewalk, access ramps, and street lights. Subsection b. A forty-five (45) -foot right -of -way dedication from centerline of Confederate Boulevard along the frontage of the property at 2129 Confederate Boulevard and a twenty (20) -foot radial dedication at the corner of Confederate Boulevard and East 30`h Street will be required prior to issuance of the certificate of occupancy. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same that are with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
