HomeMy WebLinkAbout204892011062886 Received: 10/24/2011 12:59:55 PM Recorded: 10/24/2011 01:06:36 PM Filed & Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUIT /COUNTY CLERK Fees $25.00 1 ORDINANCE NO. 20,489 2 AN ORDINANCE TO CONDEMN CERTAIN STRUCTURES IN THE 3 CITY OF LITTLE ROCK AS STRUCTURAL, FIRE AND HEALTH 4 HAZARDS; TO PROVIDE FOR SUMMARY ABATEMENT 5 PROCEDURES; TO DIRECT THE CITY ATTORNEY TO TAKE SUCH 6 ACTION AS IS NECESSARY TO RAZE AND REMOVE SAID 7 STRUCTURES; TO DECLARE AN EMERGENCY; AND FOR OTHER 8 PURPOSES. 9 10 WHEREAS, certain structures in the City of Little Rock, Arkansas, identified in this resolution have 11 become run -down, dilapidated, unsightly, dangerous, obnoxious and detrimental to the public welfare of 12 the citizens of Little Rock; and 13 WHEREAS, the condition of these structures constitutes a serious structural, fire and health hazard; 14 and 15 WHEREAS, such structures are a public nuisance and are dangerous to the health and safety of the 16 occupants or other persons and, further, are in such condition as to be dangerous to the lives, limbs and 17 property of people in its vicinity or those lawfully passing thereby; and 18 WHEREAS, the owners of the structures have received proper legal notice to either rehabilitate or 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 remove the structures and have failed to do so; and WHEREAS; such structures are hereby declared a nuisance and immediate action is necessary to demolish the structures; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The conditions of the structures on the properties described below have been found to present structural, fire and health hazards and are dangerous to the health and safety of the occupants or other persons, and further, the structures are in such condition as to be dangerous to the lives, limbs and property of people in its vicinity or those lawfully passing thereby. The City Manager is hereby authorized to institute such proceedings against such persons as may be necessary in order to enforce the provisions of this ordinance so as to remedy the unsightly and dangerous conditions brought about as a result of the failure of the owners thereof to maintain this property. Section 3. The Housing and Neighborhood Programs Department of the City of Little Rock is also authorized to raze and remove said buildings and file and enforce a lien against said property for the cost of razing and removing said structures pursuant to Section 20 -32 of the Little Rock Code of Ordinances. Unless the provisions of this ordinance are put into effect immediately, the public health, safety and welfare of the citizens of Little Rock will be adversely affected; therefore, an emergency is hereby declared to exist, and this ordinance shall be in full force and effect from and after its passage.
