NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That the zoning classification of the following described property be changed from R -2 to POD: Part of the NW '/4 NE '/4 of Section 9, T -1 -N, R -13 -W, Little Rock, Pulaski County, Arkansas, more particularly described as follows: Beginning at a point on the north line of said NW '/4 NE '/4, 81.25 feet, east of the northwest corner thereof, thence S87 053'25 "E, 81.25 feet; thence S02 °45'03 "W, 536.00 feet to point on the west line of Lot 2, Westview Medical Addition to the City of Little Rock, Pulaski County, Arkansas; thence N87 052'52 "W, 164.50 feet to a point on the west line of said NW '/4 NE '/4; thence NO2 °55'08 "E along said west line, 281.00 feet; thence S87 °53'25 "E, 81.47 feet; thence NO2 057'52 "E, 255.0 feet to the point of beginning, containing 1.5368 acres. Less and Except the North thirty (30) feet for Kanis Road right -of -way. Section 2. That the approval of Watts Short -Form POD (Z- 8685), located at 11517 Kanis Road, is subject to compliance with the following additional conditions: That the preliminary site development plan/plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. Section 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. That the change in zoning classification contemplated for Watts Short -Form POD (Z- 8685), located at 11517 Kanis Road, is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
