3 A RESOLUTION TO AMEND LITTLE ROCK, ARK., RESOLUTION NO.
4 13,246 (DECEMBER 7, 2010) TO CHANGE THE TERM OF THE
5 CONTRACTS WITH FLEMING ELECTRIC, INC.; AND FOR OTHER
6 PURPOSES.

8 WHEREAS, on December 7, 2010, Little Rock, Ark., Resolution No. 13,246 was adopted to
9 authorize the City Manager to enter into contracts with Fleming Electric, Inc., as primary contractor, and
10 Staley Electric, LLC, as secondary contractor, to provide overflow electrical services as required, on an
11 hourly basis as set forth in the awarded bids; and
12 WHEREAS, the term of the contracts should be for one (1) -year only, with no provision for
13 additional extension periods;
14 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
15 OF LITTLE ROCK, ARKANSAS:
16 Section 1. Section 2 of Resolution No. 13,246 is hereby amended to read as follows:
17 "Section 2. These contracts are for a term of one (1) calendar year from the date of
18 execution, provided the City has sufficient funds to pay for any required services.
19 Section 2. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
20 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
21 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
22 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
23 resolution.
24 Section 3. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent
25 with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
