HomeMy WebLinkAbout132232010081780 Received: ID30j2010 12:52:17 Pk-� Recorded: 12,130+ 21010 12:55:58 PA,11 FP ed & Recorded in official RecordS, of PAT OTR!Ei\� PULASKI COUNITY CIRCUMCOUN7f CLERK Eees $35,00 I RESOLUTION NG. 2 3 A RESOLUTION TO AUTHORIZE THE PURCHASE OF PROPERTY 4 OFFERED FOR SALE TO THE CITY OF LITTLE ROCK, TO BE USED 5 FOR NEIGHBORHOOD REVITALIZATION PROGRAMS; AND FOR 6 OTHER PURPOSES. 7 WHEREAS, the Board of Directors has stated as one of its goals a desire to provide for 8 neighborhood revitalization, and has taken special efforts to accomplish this goal through its use 9 of various City and federal funds, and in affirmative actions such as the creation of a Land Bank 10 Commission; and, 11 WHEREAS, in order to accomplish this goal it is required that properties be obtained by the 12 City in areas that are appropriate for revitalization; and, 13 WHEREAS, the Land Bank Commission has chosen a focus area which encompasses the 14 area of Interstate 630 as the northern boundary, Pine Street as the western boundary, 17th Street 15 as the southern boundary, and Martin Luther King, Jr., Drive as the eastern boundary. 16 WHEREAS, the Land Bank Commission has identified a property within its focus area, as 17 listed in Exhibit A to this Resolution, which can be used to fulfill the City's stated goals; and, 18 WHEREAS, City Staff has obtained a full title search on the property which revealed valid 19 title and no significant title issues; and, 20 WHEREAS, City staff has performed an environmental assessment of the property pursuant 21 to 24 C.F.R. § 58, et seq. (2003), which revealed no environmental problems; and, 22 WHEREAS, the owner of the property has paid all real estate taxes levied through 2009; 23) and, 24 WHEREAS, funds to pay the purchase price of $1,200.00 is available in the Land Bank's 25 Community Development Block Grant (CDBG) Account No. 230009-G62409; and, 26 WHEREAS, the owners of the property, David L. and Angela D. Felkins, have provided the 27 City with a warranty deed for the property, a copy of which is attached as Exhibit B; and, 28 WHEREAS, pursuant to state law the City must obtain authority to purchase property by a 29 resolution adopted by the Board of Directors; [PAGE I of 51 Resolution to authorize the purchase of properties to be used for neighborhood revitalization programs I 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: , Section 1. Pursuant to Ark. Code Ann. § 14- 54- 302(c) (West Supp. 2010), the City must obtain authority from the Board of Directors to purchase the property, as listed in Exhibit A to this resolution. Section 2. The Board of Directors, pursuant to Ark. Code Ann. § 14- 54- 302(c) (West Supp. 2010), must authorize the Mayor and City Clerk to execute any documents necessary to complete the purchase of the property listed in Exhibit A to this resolution. Section 3. If acquired, these properties shall be used for a public purpose, specifically for City neighborhood revitalization programs. Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect a if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this resolution are hereby repealed to the extent of such inconsistency.
