3 A RESOLUTION TO AUTHORIZE THE CITY MANAGER TO ENTER
4 INTO A CONTRACT WITH SOUTHWEST FENCE COMPANY TO
5 CONSTRUCT A FENCE AROUND PROPERTY ACQUIRED FOR
6 RECREATIONAL PURPOSES FROM CENTRAL ARKANSAS WATER;
7 AND FOR OTHER PURPOSES.

9 WHEREAS, the City has recently acquired property for recreational purposes from Central
10 Arkansas Water, under the condition that a fence be constructed to protect the quality of drinking
11 water; and
12 WHEREAS, installation of a fence would also deter inappropriate access to the property by
13 intruders who might attempt to damage the grounds; and
14 WHEREAS, Bid #0261R was advertised, and on September 21, 2010, it was determined that
15 Southwest Fence Co. had submitted the most responsive and responsible bid in the amount of
16 One Hundred Thirty Thousand Dollars ($130,000.00).
17 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
18 THE CITY OF LITTLE ROCK, ARKANSAS:
19 Section 1. The City Manager is hereby authorized to enter into a contract with Southwest
20 Fence Company for the construction of a fence around newly acquired property in Natural
21 Steps, in the amount of One Hundred Thirty Thousand Dollars ($130,000.00).
22 Section 2. The funds for the contract are available from park bonds refinancing.
23 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause,
24 phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such
25 declaration or adjudication shall not affect the remaining portions of the resolution, which shall
26 remain in full force and effect as if the portion so declared or adjudged invalid or
27 unconstitutional were not originally a part of the resolution.
28 Section 4. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with
29 this resolution are hereby repealed to the extent of such inconsistency.
