3 A RESOLUTION TO AUTHORIZE USE OF EMINENT DOMAIN ON THE
4 INTERSTATE 430/INTERSTATE 630 INTERCHANGE MODIFICATION; AND
5 FOR OTHER PURPOSES.

7 WHEREAS, attempts to acquire some right -of -way, permanent construction easements and
8 temporary construction easements necessary for the construction of the Interstate 430 /Interstate 630
9 Interchange modification on Financial Center Parkway have been unsuccessful due to an inability to reach
10 a settlement for the acquisition of this real property; and
11 WHEREAS, efforts will continue to acquire the necessary property without the use of eminent
12 domain.
13 NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY
14 OF LITTLE ROCK, ARKANSAS:
15 Section 1. The City is hereby authorized to use eminent domain to complete acquisition of right -of-
16 way, temporary construction easements and permanent construction easements for real property located
17 at 11219 Financial Centre Parkway; 10900 Financial Centre Parkway; 11901 Financial Centre Parkway
18 and 11300 Financial Centre Parkway.
19 Section 2. The funding for this project is available from the Arkansas State Highway &
20 Transportation Department.
21 Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or
22 word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or
23 adjudication shall not affect the remaining portions of the resolution which shall remain in full force and
24 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the
25 resolution.
26 Section 4. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with
27 the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
28 Section 5. This resolution will be in full force and effect from and after the date of its adoption.
