Code Ann. § 14 -54 -104; and WHEREAS, the Board has determined that the easement is located entirely within the applicant's property but there is a point of contact with an abutting property. WHEREAS, all utility companies and the Public Works Department have approved abandoning the easement and no facilities are currently located in or planned for the easement. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby releases, vacates, and abandons the ten (10) -foot wide, utility and drainage easement located along the South perimeter of property described as Lot 34, except the west eighty (80) feet thereof, Spring Valley Manor Subdivision (27 Vista Drive), in the City of Little Rock, Arkansas. Section 2. A copy of this ordinance, duly certified by the City Clerk, shall be filed in the real estate records of the recorder of the Circuit Clerk in ex- officio recorder of Pulaski County, Arkansas. Section 3. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged to be invalid or unconstitutional were not originally a part of the ordinance. Section 4. Repealer.
