That the zoning classification of the following described property be changed from 0-3, General Office District, to POD: 14 Part of the northwest quarter of the northwest quarter of Section 10, Township 1 North, 15 Range 13 West, in Pulaski County, Arkansas, more particularly described as follows: 16 Commencing at the northwest corner of said Section 10; thence south 87 degrees 31 17 minutes 50 seconds east for 215.77 feet; thence south 02 degrees, 08 minutes 13 seconds 18 west for 170.42 feet; thence south 87 degrees 15 minutes 18 seconds east for 240.52 feet; 19 thence south 02 degrees 48 minutes 19 seconds west for 271.93 feet; thence north 88 20 degrees 02 minutes 32 seconds west for 113.37 feet; thence south 02 degrees 24 minutes 21 12 seconds west for 126.12 feet to an iron pin found at the point of beginning; thence 22 continue south 02 degrees 24 minutes 12 seconds west for 10 1. 11 feet to a pipe filled 23 with concrete found; thence south 87 degrees 54 minutes 51 seconds east for 308.84 feet 24 to an iron pin, found; thence north 02 degrees 11 minutes 04 seconds east for 308.54 feet 25 to an iron pin, found; thence north 02 degrees 11 minutes 04 seconds east for 101.01 feet 26 to a #4 rebar, set; thence north 87 degrees 53 minutes 42 seconds west for 308.45 feet to 27 the point of beginning, and containing 0.72, acres more or less, and may be subject to 28 rights of way, easements or restrictions, recorded and unrecorded. 29 Section 2. That the approval of Fewell Short-Form POD (Z- 8644), located at 1226 Kaufman Road, is 30 subject to compliance with the following additional conditions: 31 • That the preliminary site development plan /plat be approved as submitted, including 32 all staff comments and conditions as outlined in the Planning Commission Agenda 33 Staff Report in paragraphs D, E, F and including any conditions indicated in the staff [PAGE 1 OF 2] I analysis in paragraph H and subject to additional conditions imposed at the Planning 2 Commission Public Hearing as amended by the applicant. 3 • Any 0-3, General Office District, uses of the property will require the construction of 4 the required parking. 5 Section 3. That the preliminary site development plan /plat be approved as recommended by the 6 Little Rock Planning Commission. 7 Section 4. That the change in zoning classification contemplated for Fewell Short -Form POD (Z- 8 8644), located at 1226 Kaufman Road, is conditioned upon obtaining a final plan approval within the time 9 specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. 10 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little 11 Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects 12 necessary to affect and designate the change provided for in Section 1 hereof. 13 Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the 14 plan. 15 Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or 16 word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or 17 adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and 18 effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the 19 ordinance. 20 Section 8. Repealer.
