Records of a Filed g 1 ORDINANCE NO. 20,399 COUNTY CIRCUIT / COUNTY Crane. $2o.00 CLERk 2 3 AN ORDINANCE TO APPROVE A PLANNED ZONING DEVELOPMENT AND 4 ESTABLISH A PLANNED COMMERCIAL DISTRICT TITLED RED'S 5 TOWING INC., SHORT -FORM PD -C (Z- 8556), LOCATED AT 2227 -2229 6 WILSON ROAD, LITTLE ROCK, ARKANSAS, AMENDING THE OFFICIAL 7 ZONING MAP OF THE CITY OF LITTLE ROCK; AND FOR OTHER 8 PURPOSES. 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS. Section 1. That the zoning classification of the following described property be changed from R -2 to PD -C: Lots 1 and 2 Block 3 Hick's Interurban Addition to the City of Little Rock, Pulaski County, Arkansas, as shown in Plat Book 1, Page 227; Records of Pulaski County, Arkansas. Section 2. That the approval of Red's Towing Inc., Short -Form PD -C (Z- 8556), located at 2227- 2229 Wilson Road, is subject to compliance with the following additional conditions: • That the preliminary site development plan /plat be approved as submitted, including all staff comments and conditions as outlined in the Planning Commission Agenda Staff Report in paragraphs D, E, F and including any conditions indicated in the staff analysis in paragraph H and subject to additional conditions imposed at the Planning Commission Public Hearing as amended by the applicant. • The approval of the PD -C zoning is limited to Larry Warner, Red's Towing, and is not a transferable use to any other business operator. • All access to the site is to be via West 24`" Street. • All parking areas are to be constructed of a hard surface material with materials as allowed in the City's Zoning Ordinance. Section 3. That the preliminary site development plan/plat be approved as recommended by the Little Rock Planning Commission. Section 4. That the change in zoning classification contemplated for Red's Towing Inc., Short-Form PD -C (Z- 8556), located at 2227 -2229 Wilson Road, is conditioned upon obtaining a final plan app "`a " within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of OrdinarZc'�a� [PAGE 1 OF 21 =y A t' d' ��OUNTV, 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 6. That this Ordinance shall not take effect and be in full force until the final approval of the plan. Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
